HomeMy WebLinkAboutR-1288 - Stating its intention to expand the rural utility service area boundaries by including certain property on the West side of I-5CIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO.I~~g A RESOLUTION OF THE CITY OF MARYSVILLE STATING ITS INTENTION TO EXPAND THE RURAL UTILITY SERVICE AREA BOUNDARIES BY INCLUDING CERTAIN PROPERTY ON THE WEST SIDE OF I-5. WHEREAS,Sections 14.32.030 and 14.32.050(1)of the Marys- ville Municipal Code require the adoption of a Rural Utility Service Area plan for all properties located outside of the City limits which are connected to City utility services;and WHEREAS,such a RUSA plan has been duly adopted by the Marysville City Council and recorded in the records of the Snohomish County Auditor under Auditor's File No.8208120212;and WHEREAS,certain properties on the west side of I-5 have applied for inclusion within the City's RUSA boundaries,and the City has held duly-advertised public hearings on said applica- tions;and WHEREAS,the City desires to have its intention to expand the RUSA boundaries approved by the Snohomish County Boundary Review Board before taking final action on the same;NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: Section 1.The City hereby states its intention to expand the boundaries of the Rural Utility Service Area to include the J &H building site (tax lot 4-008),as depicted on the map attached hereto as Exhibit A.City utility services to said property shall be subject to compliance with all provisions of Title 14 of the Marysville Municipal Code,and the following restrictive covenants: a.Only one City water and one City sewer connection shall be allowed for the property. b.City utility services to the property shall be used exclusively for land uses which would be allowed in the Industrial Park Zone and/or the Business Park Zone of the Snohomish County Code.No retail uses shall be allowed unless a variance is issued by the City Council in accor- dance with the provisions of Section 14.32.060(d)of the Marysville Municipal Code. Resolution - 1 ,"~ ·, c.Water usage on the property shall not exceed 12,000 gallons per day. d.The owners of the property shall immediately upgrade the existing water and sewer lines to City standards and shall convey the same,including necessary easements,to the City. e.All utility services shall be subject to termina- tion,without liability to the City of Marysville,if the Department of Interior and/or the Tulalip Tribes hereafter revoke the City's right to utility easements on Indian Trust property. Section 2.The City hereby states its intention to expand the boundaries of the Rural Utility Service Area to include the Hewlett Packard property (tax lots 4-005 and 4-006),as depicted on the map attached hereto as Exhibit A.City utility services to said property shall be subject to compliance with all provi- sions of Title 14 of the Marysville Municipal Code,and the following restrictive covenants: a.Only one City water and one City sewer connection shall be allowed for the property. b.City utility services to said property shall be used exclusively for land uses allowed in the Industrial Park Zone and/or the Business Park Zone of the Snohomish County Code.No retail uses shall be allowed unless a variance is issued by the City Council in accordance with the provisions of Section 14.32.060(d)of the Marysville Municipal Code. c.Water useage on the property shall not exceed 35,000 per day. d.All utility services shall be subject to termina- tion,without liability to the City of Marysville,if the Department of Interior and/or the Tulalip Tribes hereafter revoke the City's right to utility easements on Indian Trust property. Section 3.The City hereby states its intention to expand the boundaries of the Rural Utility Service Area to include the Tri-Way Manufacturing property (the north 6 acres of tax lot 4- 003),as depicted on the map attached hereto as Exhibit A.City utility services to said property shall be subject to compliance with all provisions of Title 14 of the Marysville Municipal Code, and the following restrictive covenants: a.Only two City water and two City sewer connections shall be allowed for the property.
