HomeMy WebLinkAboutR-1340 - Modifying its moratorium on RUSA variancesCIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO.13~ A RESOLUTION OF THE CITY OF MARYSVILLE MODIFYING ITS MORATORIUM ON RUSA VARIANCES. WHEREAS,on September 22,1986 the City Council passed Resolution No.1228 imposing a temporary moratorium on RUSA variances,and said moratorium has been extended by Resolution numbers 1243,1265, 1290,1324 and 1335;and WHEREAS,on November 14,1988 the City Council held a public meeting on the question of continuing the status of said morator- ium,and based upon the testimony and exhibits presented at said meeting it entered the following Findings of Fact: 1.On October 19,1988 the Snohomish County Council passed Motion *88-208 declaring North Snohomish County a Critical Water Supply service Area and initiating a three-year study of regional utility needs pursuant to RCW 70.116;and 2.The City Council has initiated a study on expanding the RUSA boundaries and has prepared a tentative map of new boun- daries which must now be processed through an environmental review procedure and public hearings before the Planning Commis- sion and City Council;and 3.Formal adoption of the City's expanded RUSA boundaries should be coordinated with the County's CWSSA study;and 4.As a participant in the County's CWSSA study the City will not recommend that its utility service area be extended beyond the proposed RUSA boun~aries referred to above,leaving properties outside said boundaries to be served by other public utili ties;and 5.On November 2,1988 the Everett City Council passed Resolution 3081 stating its intention to supply water to the City of Marysville on a wholesale basis in quantities large enough to serve Marysville's expanded utility service area,including properties outside said area which are under the jurisdiction of some other public utility approved by the County's CWSSA study; and 6.The City's proposed budget for 1989 includes funding of capital improvements for the City's sewer lagoon which will increase its capacity to a point where it should be able to serve all development within the proposed RUSA boundaries through the year 2000;and Resolution - 1 •..'.. 7.It would be disruptive to the CWSSA study now being undertaken by Snohomish County,and detrimental to foreseeable water and sewer capacity of the City's utility system,if properties outside of the proposed RUSA boundaries were allowed to apply for speculative variances prior to such time as the final approval of RUSA boundaries is enacted and incorporated into this CWSSA study; NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.The City Council hereby REPEALS its moratorium on RUSA variances for all properties within the proposed RUSA boundaries referred to above.Such variances shall be processed,granted and denied as provided in Section 14.32.060(d)of the Marysville Municipal Code. 2.The City Council hereby continues its moratorium on RUSA variances for all properties located outside of the proposed RUSA boundaries referred to above,except in cases of health emergencies.Said moratorium shall remain in effect until such time as Snohomish County's CWSSA study is complete and until Marysville has formally adopted its new RUSA boundaries.
