A RESOLUTION OF THE CITY OF MARYSVILLE RESCINDING THE
BINDING SITE PLAN FOR THE DEVELOPMENT KNOWN AS WOODGATE
VILLAGE AND PLACING LIMITATIONS ON THE MEDIUM-DENSITY
MULTIPLE-FAMILY ZONING CLASSIFICATION WHICH APPLIES TO
SAID PROPERTY.
WHEREAS,on November 12,1985 the City adopted Ordinance No.
1442 rezoning 18.98 acres located at 6111 64th Street N.E.from
the Single-Family Residential classification to the Medium-
Density MUltiple-Family Residential classification;and
WHEREAS,said rezone was SUbject to a binding site plan for
a development known as Woodgate Village,as documented by a
Rezone Contract dated November 12,1985 and recorded under
Snohomish County Auditor's File No.8511140130;and
WHEREAS,the owner of the subject property,Frank M.Taylor,
has asked the city for an extension of the time limit for
developing the subject property pursuant to the binding site
plan;and
WHEREAS,on August 14,1989 and August 28,1989 the City
Council held public meetings on said request for an extension,
and reached a negotiated settlement with Frank M.Taylor which is
documented herein;
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The request by Frank M.Taylor to extend the expiration
date of the above-referenced Rezone Contract and binding site
plan is hereby DENIED.A document shall be immediately recorded
in the records of the Snohomish County Auditor rescinding the
Rezone Contract.
2.The Medium-Density MUltiple-Family zoning classi-
fication for the SUbject property which was established by
Ordinance No.1442 shall remain in effect for a period of up to
nine (9)months from August 28,1989 SUbject to the following
conditions:
a.The binding site plan,including the mobile home
park overlay,previously approved for the subject property
is rescinded and is no longer part of the zoning classi-
fication of the SUbject property.
b.The owner shall not commence any development

activities on the sUbject property until such time,if ever,
that it has first obtained approval of a new binding site
plan after complying with the public hearing process
required by the city Zoning Code.
c.If the owner applies for a new binding site plan
within nine (9)months of August 28,1989 the City will
honor the Medium-Density MUltiple-Family Residential zoning
for the subject property to the extent of allowing a density
of not more than 118 dwelling units.The owner retains the
right to apply for a greater density.
3.In the event that a new binding site plan has not been
finally approved by the city within nine (9)months after August
28,1989,the zoning classification for the subject property
shall automatically revert to Single-Family Residential 7200.
