A RESOLUTION OF THE CITY OF MARYSVILLE DENYING A SEWER
MORATORIUM VARIANCE FOR PROPERTY OWNED BY BERNARD J.
SIGLER.
WHEREAS,on February 26,1990 the city of Marysville enacted
Ordinance 1763 imposing a temporary ban on new sewer connections
to the city's sewer system as the result of a capacity crisis;
and
WHEREAS,section 5 of Ordinance 1763 provides for variances
from the ban in certain unique cases;and
WHEREAS,Bernard J.Sigler applied for a variance for 86
sewer connections for mobile homes which he proposes to locate in
Cedarcrest Vista Mobile Home Park,8224 67th Avenue N.E.,
Marysville,and a pUblic hearing on said application was held by
the city Council on April 2,1990;and
WHEREAS,the City Council entered the following Findings of
Fact:
1.The subject property was annexed into the City of
Marysville on September 5,1989,and concurrently with said
annexation the property was approved for the development of
a mobile home park known as Cedarcrest vista.
2.The nearest pUblic sewer to the subject property
is 1/2 mile to the south on 67th Avenue N.E.
3.Mr.Sigler has not presented the City with any
engineering plans for construction of sewers within the
mobile home park nor has he commenced construction of any
physical improvements on the subject property.Mr.Sigler
has not applied for or been issued any development permits
for the sUbject property.
4.The sUbject property does not qualify for vested
rights under Section 2(b)of Ordinance 1763.
5.There was no evidence of any unique hardship
status relating to the subject property.

There is no existing health hazard on the subject
which would be eliminated by connection to city
7.If the sUbject property was allowed to connect to
the City's sewer system there would be a significant
generation of sewage effluent from the 86 mobile homes which
are proposed.
8.If this mobile home park were to be developed
during the period of the sewer moratorium there would be a
material detriment to public health and welfare and to the
environment.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
The application of Bernard J.Sigler for a variance from the
sewer moratorium imposed by Ordinance 1763 for Cedar crest vista
Mobile Home Park is hereby DENIED.
Any party aggrieved by this Resolution shall have a right to
file an Application for writ of Certiorari in Snohomish County
Superior Court;provided,that the Application must be filed and
served within 20 days of the date of this Resolution.
