A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A VARIANCE
TO THE SEWER MORATORIUM FOR NORTHWEST COMPOSITES,INC.
WHEREAS,on February 26,1990 the City of Marysville enacted
Ordinance 1763 imposing a temporary ban on new sewer connections
to the city's sewer system as a result of a capacity crisis;and
WHEREAS,section 5 of Ordinance 1763 provides for variances
from the ban in certain unique cases;and
WHEREAS,Northwest Composites,Inc.applied for a variance
to allow a single additional sewer connection for the construc-
tion of a new 90,000 square-foot industrial facility at 12810
39th Avenue Northeast,Marysville;and
WHEREAS,a pUblic hearing on said application was held by
the city Council on June 25,1990;and
WHEREAS,the City Council entered the following Findings of
Fact:
1.The present industrial facility operated by Northwest
Composites uses over 800,000 gallons of water per month and
generates an equivalent amount of sewage.The majority of said
water consumption and discharge is for cooling purposes only.
The facility employs approximately 250 people.
2.Northwest Composites proposes construction of an
additional facility 90,000 square feet in size that will employ
an additional 100 persons.As part of this expansion,Northwest
Composites proposes to install equipment in both the existing and
the new facility that will eliminate discharging cooling water to
the City sewer system.Cooling towers will be installed that
will result in water evaporation.
3.The net effect of the proposed construction would be to
reduce sewage effluent generated by the property by at least
500,000 gallons per month at peak rates.This would be a
significant benefit to the city sewer system.
4.Ordinance 1763 should be interpreted to encourage
developments and construction techniques that reduce the genera-
tion of sewage effluent.

NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
A variance to Ordinance 1763 is hereby granted to Northwest
composites,Inc.allowing a single additional sewer connection
for the new facility being constructed at 12810 39th Avenue
Northeast,Marysville.This variance is conditioned upon the
following requirements:
1.within three months of the date of this variance,the
Northwest Composites property shall demonstrate a net reduction
in peak discharges of sewage effluent by no less than 500,000
gallons per month.
2.Northwest Composites,Inc.shall sign a covenant
agreeing to petition for and/or consent to an annexation of its
property immediately upon the same becoming contiguous to the
city limits or upon its being included within a larger annexation
proposal,pursuant to section 14.32.040 of the Marysville
Municipal Code.
3.This variance shall become void if the construction of
the sewer connection referred to herein is not completed within
six months of the date of this Resolution.
Any party aggrieved by this Resolution shall have a right to
file an Application for writ of certiorari in Snohomish County
Superior Court;provided,that the Application must be filed and
served within 20 days of the date of this Resolution.
