A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A
VARIANCE TO THE SEWER MORATORIUM FOR HENK SPOELSTRA.
WHEREAS,on February 26,1990 the city of Marysville enacted
Ordinance 1763 imposing a temporary ban on new sewer connections
to the City's sewer system as the result of a capacity crisis;
and
WHEREAS,Section 5 of Ordinance 1763 provides for variances
from the ban in certain unique cases;and
WHEREAS,Henk Spoelstra applied for a variance for a house
located at 5621 -88th Street N.E.,Marysville and a pUblic
hearing on said application was held by the City council on July
23,1990;and
WHEREAS,the city Council entered the following Findings of
Fact:
1.Mr.Spoelstra intends to demolish a house presently
existing on the subject property.In preparation for building a
new house on said property Mr.Spoelstra has had his on-site
septic system inspected.On June 7,1990 and inspection report
indicated that the septic system is in total failure and that it
is unlikely that any effective repair work can be done.The
system is currently causing a health hazard on the property.
2.Allowing a connection to the city's sewer system for
the Spoelstra property would eliminate an existing health hazard.
3.No significant generation of sewage effluent would
result from connecting one single-family house to the city's
sewer system.
4.No material detriment to pUblic health and welfare or
to the environment would result from connecting the Spoelstra
house to the city's sewer system.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
A variance to Ordinance 1763 is hereby granted to Henk
Spoelstra allowing a sewer connection for a new single-family
residence to be constructed at 5621 -88th Street N.E.,Marys-
ville,as a replacement for the residence presently located
thereon.This variance shall only apply to one connection on
the Spoelstra property regardless of future subdivisions which

may occur.As a condition of this variance the Spoelstra
residence must also be connected to Marysville water.
This variance shall become void if the sewer connection is
not completed within six (6)months after the date of this
resolution.
Any party aggrieved by this resolution shall have a right to
file an application for writ of certiorari in Snohomish County
Superior Court;provided,that the application must be filed and
served within twenty (20)days of the date of this resolution.
