A RESOLUTION OF THE CITY OF MARYSVILLE AUTHORIZING ENCROACH-
MENT BY A BUILDING WALL OVER A PUBLIC SIDEWALK ON THE SOUTH SIDE
OF FOURTH STREET N.E.
WHEREAS,Pete Contoravdis is the owner of the Foxe &Meyer
Building located at 314 State Avenue;and
WHEREAS,said building is being extensively remodeled;and
WHEREAS,Mr.Contoravdis intends to construct a brick
veneer on the exterior of the north side of the building which
will encroach by three inches over the pUblic sidewalk on the
south side of Fourth Street N.E.;and
WHEREAS,said sidewalk is seven feet in width at the present
time;and
WHEREAS,other sidewalks in this vicinity have been narrowed
for the purpose of providing room for on-street parking,and it
has been determined that such narrowing does not constitute a
hazard to pUblic health,safety or welfare;and
WHEREAS,the city Council finds that the three-inch
encroachment is de minimus and will enable Mr.Contoravdis to
significantly improve the appearance of the Foxe &Meyer Build-
ing;
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
Pete Contoravdis is hereby authorized to remodel the north
side of the Foxe &Meyer Building with a brick veneer wainscoting
which encroaches by up to three inches over the City's public
sidewalk on Fourth Street N.E.Such encroachment shall not
constitute a relinquishment of the City's ownership rights
relating to public right-of-way.Rather,it shall be construed
as a revocable license granted by the city for the use of such
right-of-way at the pleasure of the City.
