HomeMy WebLinkAboutR-1460 - Granting a variance to the sewer moratorium for the Sleasman propertyCITY OF MARYSVILLE Marysville,Washington RESOLUTION NO./.# A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A VARIANCE TO THE SEWER MORATORIUM FOR THE SLEASMAN PROPERTY. WHEREAS,on August 13,1990 the city of Marysville enacted Ordinance 1795 imposing a temporary ban on new connections to the city's sewer system as the result of a capacity crisis at the City's wastewater treatment facility;and WHEREAS,section 8 of said Ordinance provides for variances from the ban in certain hardship cases;and WHEREAS,JACK R.SLEASMAN applied for a variance for a residence located at 9212 -GIst Drive N.E.,Marysville,Washing- ton;and WHEREAS,a pUblic hearing on said application was held by the city Council on January 7,1991;and WHEREAS,the City Council entered the following Findings of Fact: 1.The septic system at the SLEASMAN property has failed and is irreparable.A letter from the Snohomish Health District dated December 24,1990 indicates that untreated septic tank effluent was wicking up to saturate the ground surface,creating a potential for pUblic exposure to sewage.Said conditions are causing a health hazard. 2.There is no City sewer line crossing the frontage of the SLEASMAN property on GIst Drive N.E.Connection to a sewer main will require an extension of the sewer main from Oakwood Estates. 3.If the SLEASMAN property is connected to the City's sewer system,no significant quantity of sewage and no sig- nificant organic loading will be discharged into the system. 4.No material detriment will result to the public health or welfare or the environment 5.No violation of the DOE Consent Order will result. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: Resolution - 1 ~----------------_._----~---------------------------------, ""'~.~~i. ~~.~. A variance to Ordinance 1795 is hereby granted to JACK R. SLEASMAN allowing a sewer connection to his residence at 9212 - G1st Drive M.E.,Marysville,Washington.This variance is subject to the following conditions: 1.JACK R.SLEASMAN must comply with all requirements for City sewer connections,including execution of an Annexation Covenant and extension of the sewer main from Oakwood Estates across the frontage of his property. 2.This variance shall become void if the sewer connection is not completed within six months of January 7,1991. 3.JACK R.SLEASMAN may contact the city to further explore alternative methods of funding the extension of the sewer main from Oakwood Estates. Any party aggrieved by this Resolution shall have the right to file an application for Writ of Certiorari in Snohomish County Superior Court;PROVIDED,that the application must be filed and served within 20 days of the date of this Resolution.
