A RESOLUTION OF THE CITY OF MARYSVILLE AUTHORIZING
PUBLICATION OF A FORMAL ORDER PURSUANT TO RCW
42.17.260(3)SPECIFYING THE REASONS WHY THE PROVISION
OF A CURRENT INDEX CONCERNING PUBLIC RECORDS WOULD BE
UNDULY BURDENSOME AND WOULD INTERFERE WITH AGENCY
OPERATIONS.
WHEREAS,RCW 42.17.260 provides that local agencies,
including cities,make available all public records,unless
records fall within a specific exemption of the Public Records
Act;and
WHEREAS,local agencies,including cities,are to maintain
and make available for pUblic inspection and copying a current
index providing identifying information as to records issued,
adopted,or promulgated after January 1,1973;and
WHEREAS,RCW 42.17.260(3)provides that local agencies,
including cities,need not maintain such an index if to do so
would be unduly burdensome,and in such cases cities may issue
and publish a formal order specifying the reasons why and the
extent to which the provision of an index would be unduly
burdensome or interfere with the city's operations;
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The city Administrator is hereby directed to issue and
publish the following Order in accordance with RCW 42.17.260(3):
Compliance with the Public Records Indexing Require-
ment of RCW 42.17.260(2)has been determined to be
unduly burdensome and would interfere with certain City
operations for the following reasons:
a.The City,and each of its departments,
has had on file since January 1,1973 hundreds,
and probably thousands,of documents which would
necessitate indexing.
b.There is presently insufficient staff
available to dedicate the amount of time necessary
to compile an index of all records required by RCW
42.17.260(2).

c.There are insufficient funds budgeted
for compiling a current index relating to all
records since January 1,1973.
d.Indexing of the records required under
RCW 42.17.260(2)would interfere with the regular
job responsibilities of City staff and would
detract from other services which are presently
being provided to the pUblic by such staff.
2.The Order as provided above shall not be construed to
relieve the City of its obligation under RCW 42.17.260(3)(b)to
make available for public inspection and copying all indexes
presently in existence and maintained for City use which are not
otherwise exempt from disclosure under the Public Records Act.
3.This Resolution,and the Order contained herein,shall
be published in the legal section of the city-designated news-
paper of general circulation.
