HomeMy WebLinkAboutR-1470 - Extending the preliminary plat of Clovedale and imposing condtionsCITY OF MARYSVILLE Marysville,Washington RESOLUTION NO.FIla A RESOLUTION OF THE CITY OF MARYSVILLE EXTENDING THE PRELIMINARY PLAT OF CLOVERDALE AND IMPOSING CONDITIONS. WHEREAS,the Preliminary Plat of Cloverdale was approved on September 28,1987;and WHEREAS,said preliminary plat would expire pursuant to RCW 58.17.140 and MMC 20.16.200 unless a written request is made to the City Council;and WHEREAS,by letter of February 19,1991 the property owner and applicant requested an extension of time to complete the Plat of Cloverdale,located at 88th Street N.E.and 67th Avenue N.E., in Marysville,Washington;and WHEREAS,pursuant to Ordinance No.1834 the Marysville City Council provided for extensions of preliminary plats upon a showing of good cause if a written request is received by the city Council within six months of the expiration of the three- year preliminary plat period;and WHEREAS,Ordinance No.1834 and RCW 58.17.140 authorize the City to grant an extension on the condition that additional or altered requirements be met by the applicant;NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYS- VILLE,WASHINGTON AS FOLLOWS: 1.The applicant made a request for an extension of time to complete the Preliminary Plat of Cloverdale within six months of September 28,1991. 2.Pursuant to the applicant's letter of February 19, 1991,which is incorporated herein by this reference,and pursuant to information provided orally at the March 4,1991 City Council meeting,the applicant has shown good cause why an extension of time to complete the Preliminary Plat of Cloverdale is warranted. 3. one year 1992,on The Preliminary Plat of Cloverdale from the date of its expiration,or the following conditions: shall be extended until September 28, a.The applicant shall assure compliance with the Army Corps of Engineers wetland standards. RESOLUTION - 1 b.The applicant agrees to participate in the 67th Avenue N.E.LID (LID #64)based upon the final assess- ment roll amount,or in the event said LID fails,the applicant shall be required to construct frontage improve- ments consistent with the requirements of the Marysville Municipal Code and construction plans previously approved by the City Director of Public Works.Frontage improvements shall include,but are not limited to,storm drainage improvements,vertical realignment of 67th Avenue N.E., paving,widening,right-of-way dedication,curbs,gutters and sidewalks. c.Submittal of a grading and erosion control plan to reduce the propensity for siltation in the affected creek system. d.Payment of all mitigation fees pursuant to TIP #2 and #3 which shall be paid at the time of issuance of building permits. Each of the above-referenced conditions shall be imposed in addition to those conditions which have previously been imposed in connection with the original preliminary plat approval. /1• PASSED by the City Council and APPROVED by the Mayor this day of ~,1991 .
