I CITY OF MARYSVILLE,WASHINGTON RESOLUTION NO.JL/?J- A RESOLUTION of the City Council of the City of Marysville,Washington,declaring its intention to initiate the formation of utility Local Improvement District No. 17 to carry out the system or plan of additions to and betterments and extensions of the waterworks utility of the City, including the system of sewerage as a part thereof,as adopted by Ordinance No. 937 to serve certain areas of the City,all as applicable to such utility local improvement district;and fixing the date,time and place for a public hearing on the formation of the proposed utility local improvement district. WHEREAS,the City of Marysville,Washington (the "City"),by Ordinance No. 385 passed September 2,1952, combined the sewerage system of the City and all additions and improvements thereto with the waterworks utility of the City,and the sewerage system at all times since has been considered a part of and belonging to the waterworks utility of the City,and the words "waterworks utility for the City" hereinafter shall mean the combined sewerage system and water system of the City,together with all additions thereto and betterments and extensions thereof hereafter made;and WHEREAS,pursuant to Ordinance No. 937 passed July 9,1979,the City Council in adopting the Lower Snohomish River Basin Waste Water Facilities Planning Study for the Marysville Sub-region specified and adopted a system or plan of additions to and betterments and extensions of the waterworks utility of the City;and 1 ------------------- WHEREAS,the City Council has determined it to be in the best interests of the City that a portion of such system or plan of additions to and betterments and extensions of the waterworks utility of the City be undertaken and that a utility local improvement district be formed within the area hereinafter more particularly described;NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,as follows: Section 1.It is the intention of the City Council of the City to order the acquisition and construction of the portion of the system or plan of additions and betterments and extensions of the waterworks utility of the City as adopted in Ordinance No. 937 passed by the City Council and approved by the Mayor on July 9, 1979,to serve a certain area of the City and applicable to the proposed utility local improvement district hereinafter described.The nature and territorial extent of such proposed improvement consists of the construction and installation of an a-inch sanitary sewer main and appurtenances along 61st Drive N.E.from a point approximately 120 feet north of 93rd Place N.E.south to a point on the southerly boundary of the Plat of Roncrest as recorded in Volume 26,pages 100 and 101 Records of Snohomish County,Washington. 2 Section 2.To carry out the foregoing system or plan of additions to and betterments and extensions of the waterworks utility of the City,there shall be formed a utility local improvement district to be known and designated as utility Local Improvement District No. 17 of the City of Marysville,Washington,the boundaries of which are described in Exhibit A attached hereto and incorporated herein by this reference. Section 3.The estimated cost and expense of the portion of the system or plan of additions to and betterments and extensions of the waterworks utility of the City applicable to ULID No. 17 is declared to be approxi- mately $45,000.00,all of which cost shall be borne by and assessed against the property included within proposed utility Local Improvement District No.17,which district embraces as nearly as practicable all property specially benefited by such improvements.The assessments in that utility local improvement district shall be for the sole purpose of paying the cost and expense of the improvements or for payment into the Water and Sewer Revenue Refunding Bond Fund,1977,in the event that water and sewer revenue bonds hereafter are authorized to be issued to pay for all or a part of the improvements in Utility Local Improvement District No. 17 and such bonds are issued on a parity of lien with the outstanding bonds payable out of such fund or, if not issued on a parity of lien therewith,for payment into a special bond redemption fund hereafter 3 4,'•1. created for the payment of water and sewer revenue bonds hereafter authorized to be issued by the City to provide the funds required to pay all or a part of the cost and expense of carrying out such system or plan. Section 4.In accordance with the provisions of RCW 35.44.047,the City may use any method or combination of methods to compute assessments which may be deemed to fairly reflect the special benefits to the properties being assessed. Section 5.A public hearing on the formation of utility Local Improvement District No. 17 shall be held in the Council Chambers in the Public Safety Center,1635 Grove Street,Marysville,Washington,at 7:30 p.m.,local time,on April 22,1991,at a regular meeting of the City Council then to be held at such time and place. All persons who may desire to object to the improvement and to the formation of the proposed utility local improvement district are notified to appear and present their objections at the hearing and meeting of the City Council to be held at such time and place. Section 6.The City Clerk is authorized and directed to give notice of the adoption of this resolution and of the date,time and place fixed for the public hearing to each owner or reputed owner of any lot,tract,parcel of land or other property within the proposed utility local improvement district by mailing such notice at least fifteen days before the date fixed for public hearing to the owner 4 or reputed owner of the property as shown on the rolls of the County Assessor at the address shown thereon,as required by law.The City Clerk also is authorized and directed to give notice of the adoption of this resolution and of the date,time and place fixed for the public hearing to each owner or reputed owner of any lot,tract,parcel of land or other property outside of the proposed utility local improvement district that is required by the Federal Housing Administration as a condition of loan qualification to be connected to the proposed improvements,by mailing such notice at least fifteen days before the date fixed for the public hearing to the owner or reputed owner of the property as shown on the rolls of the County Assessor at the address shown thereon,as required by law. Section 7.Larry R.Wade of Hammond,Collier & Wade-Livingstone Associates Inc.,the City's consulting engineers,is directed to submit to the City Council on or prior to April 22,1991,all data and information required by law to be submitted. 5 *::;-,l.
