WHEREAS,on May 6,1991 the Marysville City Council adopted Resolution No.1476 stating its intention to annex certain property into the city and transmitting the matter to the Snohomish County Boundary Review Board for approval;and WHEREAS,the annexation proposal as set forth in Resolution 1476 has been scheduled for public hearing before the Snohomish County Boundary Review Board on November 12,1991;and WHEREAS,since the passage of Resolution No.1476,the city has determined that it would be in the best interests of the city and certain properties within the proposed annexation area to delete those properties from the annexation area due to the fact that covenants not to protest said annexation had been signed, but not recorded with the Snohomish County AUditor; NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,AS FOLLOWS: 1.Resolution No.1476 is hereby amended by substituting the property described in EXHIBIT 1 to this Resolution for property described in EXHIBIT A to Resolution No.1476.The property described in EXHIBIT 1,attached hereto,is hereby approved for annexation into the City of Marysville and shall be so annexed by ordinance of the City of Marysville upon receipt of a favorable decision/report from the Snohomish County Boundary Review Board. 2.The city Staff is hereby directed to submit an amended notice of intent to the Snohomish County Boundary Review Board, and all other relevant information relating to the amendment of the boundaries of the SUbject annexation inclUding,but not limited to,a revised map depicting the amended annexation area and all other pertinent information from the City's files. 3.Except as amended herein,all other provisions of Resolution No.1476 shall remain in full force and effect, unchanged by this Resolution. The Marysville city Council has elected to modify and reduce the boundaries of the proposed annexation area in light of certain information that has come to light since the original notice of intent was transmitted to your office.The City has recently learned that two covenants agreeing not to protest this annexa- tion were not recorded with the Snohomish County Auditor. Because the property has changed hands since the original signing of the covenants,the City does not feel that it can count these properties toward the required 60%assessed valuation.In order to regain the required 60%and in order to respond to concerns of other property owners in the area who object to the annexation, the city has elected to delete a portion of the proposed annexa- tion area which encompasses approximately 40 acres.The area to be deleted can be ascertained by comparing the map which was originally submitted to the map which is now provided in connection with this amended proposal. The City recognizes the authority of the Boundary Review Board to,on its own,include the area which the city has now deleted. So that all affected property owners,both within the area proposed for annexation and within the deleted area,have an opportunity to address this revision to the annexation area,we are mailing a copy of this letter,along with a revised map depicting the reduced area of the annexation,to all property owners within the original proposed boundaries. 514 Delta • Marysville.
