RESOLUTION NO.I S:3 }
A RESOLUTION OF THE CITY OF MARYSVILLE APPROVING A
VARIANCE TO ALLOW A WATER CONNECTION TO PROPERTY OUTSIDE
OF RUSA FOR THE PROPERTY OWNED BY ROBERT L.JOHNSON.
WHEREAS,Robert L.Johnson is the owner of certain real
property located on the south side of 169th Place N.E.at the
intersection of 27th Avenue N.E.and 169th,Lot 14 of Johnson
Tracts;and
WHEREAS,Robert L.Johnson has applied for a variance to
allow a single-family water connection for said property;and
WHEREAS,on March 9,1992 the Marysville City Council
reviewed the variance application,including the variance
application,memorandum dated February 7,1992 from the Public
Works Director,and assessor's map;NOW,THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MARYSVILLE,WASHINGTON AS FOLLOWS:
1.Literal enforcement of the city Code would cause a
practical difficulty and unnecessary hardship for the applicant.
2.Each of the findings required for a variance to allow a
water connection to property outside of RUSA exists,and
therefore,the city Council makes the following findings:
a.The property is located within the city's boundary
established in the recently-adopted Coordinated Water System
Plan,and as such,will ultimately be served by Marysville.
b.The property is located in an area of our system
which does not experience water shortages or pressure
deficiencies during summer peaks.
c.The request is for a single-family connection,not
for development purposes.
d.Surrounding properties have a history of well
contamination.
J.Based upon the above-referenced findings,the
applicant·s request for a variance to allow a single-family water
connection to the above-referenced property is hereby approved,
SUbject to compliance with all other city ordinances,rules and
regulations.

4.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior court of
Snohomish County by Writ of certiorari,writ of Prohibition,or
Writ of Mandamus within fifteen (15)calendar days after the
passage of this resolution.
