CIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO./53 <I A RESOLUTION OF THE CITY OF MARYSVILLE AMENDING CHAPTER VII,SECTION 5,OF THE PERSONNEL RULES OF THE CITY OF MARYSVILLE RELATING TO COMPENSATORY TIME. WHEREAS,city department heads and other non-union supervisory personnel who are exempt from the provisions of the Fair Labor Standards Act (FLSA)or otherwise exempt and not eligible for overtime compensation are at times called upon to work in excess of a 40-hour work week in order to complete the responsibilities of their position;and WHEREAS,some department heads and other non-union supervisory personnel accumulate large numbers of hours of compensatory time each year which are forfeited;and WHEREAS,the City wishes to provide more flexibility for the use of accrued but unused compensatory time by enabling employees to convert excess amounts of compensatory time into paid administrative leave and by allowing larger amounts of compensatory time to be taken off at one time;NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: Chapter VII,Section 5,of the Personnel Rules of the city of Marysville is hereby amended to read as follows: Section 5.COMPENSATORY TIME: Department heads and other non-union supervisory personnel who are FLSA exempt or otherwise not eligible for overtime compensation,and any other employees designated by the City Administrator,shall be eligible for compensatory time.Compensatory time shall be granted upon prior approval by the City Administrator, or his designee.It shall be scheduled as soon as possible after accrual and with due regard for the wishes of the employee,insofar as this can be accomplished without detracting from the sound and orderly administration of the department involved.The purpose of compensatory time is to allow an employee short periods of time for personal business or to extend available vacation time.with respect to the RESOLUTION - 1 ...~'~,-"- accrual and use of compensatory time,the following rules shall apply: a.Any eligible employee who accrues 100 hours or more of compensatory time during the calendar year will be allowed to convert those hours above 40 to paid administrative leave on a one-to-four basis. b. 40 hours year. Compensatory time accruals of not more than may be carried over to the following calendar c.All eligible employees will be allowed to use no more than four days (or four shifts)of compensatory time off at anyone time. d.All eligible employees may use compensatory time to extend vacation either at the beginning or the end of the vacation period,subject to the four-day limitation referenced above. e.Earned or accrued compensatory time and administrative leave will be documented on city forms, including the date,number of hours,and the activity for which compensatory time is being claimed.Records of all compensatory time converted to administrative leave shall also be documented. f.Compensatory time will not accrue until a minimum of one-half hour has been earned. g.Any employee cannot convert compensatory time to cash compensation under any circumstances. The following rules shall apply for the accrual and use of compensatory time which has been converted to administrative leave: a.No greater than 200 hours of administrative leave may be accrued. b.Administrative leave may be used the same as vacation time with the understanding that the scheduling of such time shall not interfere with the sound and orderly administration of the department and the employee's position. c.There shall be no provision to convert accrued but unused administrative leave to cash compensation under any circumstances upon the termination of employment.
