A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A
CONDITIONAL USE PERMIT FOR PROPERTY OWNED BY ROBERT
DAGLEY,SUBJECT TO CONDITIONS.
WHEREAS,Robert Dagley owns certain real property located at
1709 -8th Street in the City of Marysville;and
WHEREAS,Robert Dagley applied to the city for a conditional
use permit to operate a "mini-day care center";and
WHEREAS,the City Hearing Examiner held a pUblic hearing on
March 12,1992 and adopted Findings of Fact,Conclusions and a
Recommendation approving the conditional use permit SUbject to
five conditions;and
WHEREAS,the City Council held a public hearing on said
conditional use permit on April 13,1992 and concurred with the
Findings of Fact,Conclusions and Recommendation of the Hearing
Examiner;NOW,THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The Findings of Fact,Conclusions and Recommendation of
the Hearing Examiner with respect to the above-referenced
conditional use permit under File No.PA 9111048 is hereby
approved.
2.The conditional use permit for the above-described
property shall be perpetually conditioned upon strict compliance
with each of the conditions set forth in the Recommendation of
the Hearing Examiner.Violation of any of the conditions of said
decision may result in revocation of the preliminary plat
approval and variances or enforcement action being brought by the
City.
3.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the superior Court of
Snohomish County by writ of certiorari,writ of prohibition,or
writ of mandamus with in fifteen (15)calendar days after the
passage of this resolution.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same

materially detrimental to the pUblic interest,welfare or
the environment.
d.The granting of the variance will not be
inconsistent with the long range plans of the City utility
system,or jeopardize utility availability for properties
within the City limits.
3.Based upon the above-referenced findings,the
application for a variance for a water connection without sewer
connection for the applicant's property is hereby granted.
4.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by writ of certiorari,writ of prohibition,or
writ of mandamus with in fifteen (15)calendar days after the
passage of this resolution.
