HomeMy WebLinkAboutR-1546 - Waiving the public bidding requirements for a vactor unit for the city's public works department.-/:p~J1/~ /-~£l.,t- CIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO./S-Yb A RESOLUTION OF THE CITY OF MARYSVILLE WAIVING THE PUBLIC BIDDING REQUIREMENTS FOR A VACTOR UNIT FOR THE CITY'S PUBLIC WORKS DEPARTMENT. WHEREAS,the city Public Works Department is in need of purchasing a Vactor-type machine for use in its pUblic works operations;and WHEREAS,the Street Superintendent for the Street Department has studied and researched the various features of the needed equipment which will serve the City's needs;and WHEREAS,the Street Superintendent has identified the brand name "Vactor"as being the only source or supply of equipment which specifically meets the city's needs;and WHEREAS,the city Street Superintendent has prepared a memorandum dated April 24,1992 outlining 14 reasons why the "Vactor"-type equipment is unique in terms of meeting the city's special needs.Said memorandum is attached hereto and incorporated by this reference.NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: Pursuant to the attached memorandum,the city hereby finds that the purchase of a "Vactor"brand equipment for the city's Street and Public Works Departments is legitimately limited to a single manufacturer,the Vactor Company.Pursuant to RCW 35.23.352(9),the City hereby waives the requirement of calling for pUblic bids for the acquisition of the SUbject equipment. The City further finds that the purchase is clearly and legitimately limited to a single source or supply and that the equipment is SUbject to special market conditions. ~PASSED by the City Council and APPROVED by the Mayor thisII~day of May,1992.
