HomeMy WebLinkAboutR-1547 - Granting a variance to allow water connection without sewer for the residence located at 6325 83rd Avenue NE owned by Henry Cook with conditions.~. -------------------------------------------, CIT Y 0 F MAR Y S V ILL E Marysville,washington RESOLUTION No./S17 A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A VARIANCE TO ALLOW WATER CONNECTION WITHOUT SEWER FOR THE RESIDENCE LOCATED AT 6325 -83RD AVENUE N.E.,OWNED BY HENRY COOK,WITH CONDITIONS. WHEREAS,on September 6,1991 applicant Henry Cook applied for a variance authorizing a water connection without sewer for the residence located at 6325 -83rd Avenue N.E.;and WHEREAS,on May 4,1992 the Marysville City Council held a pUblic meeting to consider the subject utility variance;and WHEREAS,the Marysville city council finds that there is sufficient evidence of poor water quality and low water pressure from the service provided by the existing well to the site;and WHEREAS,the sUbject property is within the Marysville Draft CWSP service boundary;and WHEREAS,the above-referenced circumstances constitute exceptional or extraordinary conditions applying to the sUbject property that do not apply generally to other properties in the same vicinity,the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by owners of other properties in the same vicinity,and the variance will not be materially detrimental to the public interest,welfare or the environment,and that the granting of the variance will not be inconsistent with the long-range plans of the city utility system or jeopardize utility availability for properties within the city limits;NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,AS FOLLOWS: The variance for the applicant·s connection to the city water system without city sewer is hereby APPROVED for the property located at 6325 -83rd Avenue N.E.,Marysville, Washington,subject to the following conditions: 1.The applicant shall be required to pay all frontage and connection fees as provided by city ordinance. 2.The applicant shall install and maintain an in-line booster pump,at his own expense. RESOLUTION - 1 3.This variance shall be limited to one single-family residential connection for the entire parcel of property. Any party aggrieved by this resolution shall have the right to file an application for a writ of certiorari in Snohomish County Superior Court;PROVIDED,that the application must be filed and served within twenty (20)days of the date of this Resolution.
