CIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO.~~~ A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE TO ALLOW A SEWER CONNECTION WITHOUT WATER FOR PROPERTY OWNED BY DUAINE AND JOANN HOLCOMB FOR THE PROPERTY LOCATED AT 8413 -55TH AVENUE N.E.,MARYSVILLE, WASHINGTON. WHEREAS,on May 12,1992 Duaine and Joann Holcomb applied to the city for a utility variance to allow a sewer connection without water for the property located at 8413 -55th Avenue N.E.,Marysville,Washington;and WHEREAS,at its regular meeting of June 1,1992 the Marysville city Council considered the application for utility variance for said sewer connection without water connection;and WHEREAS,the City Council finds that the need for the variance arises from the City's requirement for frontage on a sewer main,and the applicant was requesting to be excepted from the frontage requirement due to the cost of extending the sewer main;and WHEREAS,there are exceptional or extraordinary circumstances or conditions applying to the SUbject property that do not apply generally to other properties in the same vicinity; and WHEREAS,the granting of the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by owners of other properties in the same vicinity;and WHEREAS,the authorization of the variance will not be materially detrimental to the pUblic interest,welfare or the environment;and WHEREAS,the granting of the variance will not be inconsistent with the long range plans of the city utility system,or jeopardize utility availability for properties within the city limits;NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.The variance for the applicant's connection to the City's sewer system without water and the exception from the frontage requirement are hereby approved for the property located RESOLUTION - 1 /msvl/holcOfTb.res .:r-..,i:." at 8413 -55th Avenue N.E.,Marysville,Washington,for the property owned by Duaine and Joann Holcomb. 2.The approval of this variance shall be conditioned upon the applicant executing a covenant not to protest the formation of a future ULID or LID which would include or benefit the subject property. Any party aggrieved by this resolution shall have the right to file an application for a writ of certiorari in Snohomish County Superior Court;PROVIDED,that the application must be filed and served within twenty (20)days of the date of this resolution.
