HomeMy WebLinkAboutR-1558 - Granting a utility variance to allow water and sewer service outside of the City's Rusa and CWSP Boundaries to service a residential expansion of theCITY OF MARYSVILLE Marysville,Washington RESOLUTION NO./~ A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE TO ALLOW WATER AND SEWER SERVICE OUTSIDE OF THE CITY'S RUSA AND CWSP BOUNDARIES TO SERVICE A RESIDENTIAL EXPANSION OF THE STILLAGUAMISH SENIOR CENTER AT 18308 -35TH AVENUE N.E.,ARLINGTON, WASHINGTON. WHEREAS,on May 29,1992 the stil1aquamish Senior Center applied for a utility variance requesting water and sewer service outside of the city's Rural utility Service Area and Coordinated Water System Plan boundaries to service a residential expansion of its existing facility at 18308 -35th Avenue N.E.,Arlington, Washington;and WHEREAS,on June 8,1992 the Marysville City Council held a pUblic meeting to consider the sUbject application,received a letter from the applicant dated May 29,1992 concerning the proposed low-income HUD 202 Elderly Senior Housing project and received supplemental verbal information from Don Regan,a Board member of the Senior Center;and WHEREAS,the city Council made the following Findings of Fact: 1.There is an extreme shortage of senior housing in the Marysville/Arlington area.There are presently approximately 260 people on the waiting list for the type of housing proposed by the applicant.The projected waiting list is from three to five years. 2.There are exceptional or extraordinary circumstances or conditions applying to the subject property,and particularly to the intended use,that being the provision of senior low-income housing,that do not apply generally to other properties in the same vicinity. 3.The variance is necessary for the preservation and enjoyment of a substantial property right to the applicant,i.e., the expansion of an existing facility and the application for financing from HUD. 4.The authorization of the variance will not be materially detrimental to the pUblic interest,welfare or the environment,in light of the fact that there presently exists adequate capacity in the system to serve the proposed project with City utilities. RESOLUTION - 1 ~J _'{ "!",~.'-"'::,;:.~""•, 5.The granting of the variance will not be inconsistent with the long-range plans of the city utility system,or jeopardize utility availability for properties within the City limits considering the fact that the current proposal by the applicant is consistent with the original stillaguamish Senior Center project. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,AS FOLLOWS: The application for a utility variance to allow water and sewer service outside of the city's RUSA and CWSP boundaries for the Stillaguamish Senior Center is hereby granted,sUbject to the condition that the applicant comply with all applicable City codes including,but not limited to,Ordinance 1883,or any subsequent amendment thereto. Any party aggrieved by this resolution shall have the right to file an application for a writ of certiorari in Snohomish County Superior Court;PROVIDED,that the application must be filed and served within twenty (20)days of the date of this Resolution.
