CIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO./~bh A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FOR THE ROBERT L.JOHNSON PROPERTY LOCATED AT THE CORNER OF 27TH AVENUE N.E.AND 169TH STREET N.E., MARYSVILLE,WASHINGTON. WHEREAS,on April 3,1992 Robert L.Johnson applied for a utility variance for a sewer connection for property located at the corner of 27th Avenue N.E.and 169th Street N.E.,Marysville, Washington,for a sewer connection on property located outside of the City's RUSA boundaries;and WHEREAS,on July 13,1992,the City Council of the city of Marysville held a pUblic meeting concerning the variance application and made the following findings: 1.The applicant's property is within the area defined by the city's Coordinated Water System Plan. 2.The applicant's property is adjacent to the City's RUSA boundary and is fronted by both water and sewer mains. 3.As a result of the applicant's property being located within the city's Coordinated Water System Plan,it will ultimately be served utilities by the city of Marysville. 4.In light of recent changes in the septic design criteria adopted by Snohomish County,the construction and design of an on-site sewerage disposal system would not be cost effective for this applicant. 5.The applicant's request is consistent with the long range sewer utility planning efforts of the City of Marysville. 6.The SUbject property fronts on a City sewer main and can be served by a gravity connection to said main. 7.Connection to City utilities will not adversely affect the OLID No. 10 collection system. 8.The variance is for one single-family residence for the applicant's entire five-acre parcel and is not for development purposes. 9.The above circumstances constitute exceptional or extraordinary circumstances or conditions applying to the subject RESOLUTION - 1 /msvl/johns0n3.res ••-~~..~~...... ~,....".' property that do not apply generally to other properties in the same vicinity. 10. enjoyment possessed The variance is necessary for the preservation and of a sUbstantial property right of the applicant by owners of other properties in the same vicinity. 11.The authorization of the variance will not be materially detrimental to the public interest,welfare,or the environment. 12.The granting of the variance will not be inconsistent with the long range plans of the city utility system,or jeopardize utility availability for properties within the city limits. NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: The variance for the applicant's connection to City sewer is hereby granted sUbject to the condition that the variance shall be for one single-family residence for the entire five-acre parcel owned by the applicant. Any party aggrieved by this resolution shall have the right to file an application for Writ of Certiorari in Snohomish County Superior Court;PROVIDED,that the application must be filed and served within 20 days of the date of this resolution. ~JPASSED by the City Council and APPROVED by the Mayor this:J.(~"day of ~'>J.1i-.::::~~"",<,,1992.
