A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A
CONDITIONAL USE PERMIT AND VARIANCE FOR PROPERTY OWNED
BY DARYL BOERSEMA SUBJECT TO CONDITIONS.
WHEREAS,DARYL BOERSEMA owns certain real property located
on the north side of 67th Street N.E.,adjacent to Marysville
Middle School on the west and north boundaries in the city of
Marysville;and
WHEREAS,DARYL BOERSEMA applied to the city for a
Conditional Use Permit to construct a duplex on a lot zoned RS-
7200 and for a year yard setback variance;and
WHEREAS,the City Hearing Examiner held a public hearing on
July 27,1992 and adopted Findings of Fact,Conclusions and a
Recommendation approving the Conditional Use Permit and variances
SUbject to seven conditions;and
WHEREAS,the city Council held a pUblic meeting on said
Conditional Use Permit on July 27,1992 and concurred with the
Findings of Fact,Conclusions and Recommendation of the Hearing
Examiner;
WHEREAS,the City Council received the staff report which
was adopted as part of the Hearing Examiner's Findings of Fact;
and
WHEREAS,the City staff recommended a $200-per-unit fee for
parks mitigation and the applicant voluntarily offered to pay
such fee by letter dated June 11,1992;NOW,THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The Findings of Fact,Conclusions and Recommendation of
the Hearing Examiner with respect to the above-referenced
Conditional Use Permit under File No.PA 9205023 is hereby
approved,with an additional condition that the applicant shall
contribute $200 per unit to the city of Marysville Parks
Department as specified in the applicant's letter of June 11,
1992.
2.The Conditional Use Permit and variance for the above-

described property shall be perpetually conditioned upon strict
compliance with each of the conditions set forth in the
Recommendation of the Hearing Examiner and this resolution.
Violation of any of the conditions of said decision may result in
revocation of the Conditional Use Permit and variance or
enforcement action being brought by the City.
3.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the superior Court of
Snohomish County by Writ of certiorari,Writ of Prohibition,or
Writ of Mandamus within fifteen (15)calendar days after the
passage of this resolution.
