" CIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO./S7:J- A RESOLUTION OF THE CITY OF MARYSVILLE AUTHORIZING JOINT APPLICATION FOR FUNDING ASSISTANCE WITH SNOHOMISH COUNTY PARKS DEPARTMENT FOR THE ACQUISITION OF PROPERTIES SURROUNDING AND INCLUDING THE AREA KNOWN AS MOTHER NATURE'S WINDOW TO THE SNOHOMISH COUNTY CONSERVATION FUTURES FUND. WHEREAS,the city council of the City of Marysville had ordered an update to be completed by December 1992 of the Comprehensive Park and Recreation Plan for the urban area which identifies a passive regional park on the 15-acre site known as Mother Nature's Window on which is situated 10 acres of old growth forest and wildlife,as well as approximately 25 acres of privately-owned properties surrounding the Mother Nature's Window property;and WHEREAS,under the provisions of the Conservation Futures Fund,County funds may be authorized and made available to aid in financing the cost of land for parks and the development of outdoor recreation facilities of local public bodies;and WHEREAS,the City Council of the city of Marysville considers it in the public interest to assist in the acquisition of a regional park in the northern part of the City generally located adjacent to 100th Avenue NE,due east of 55th Avenue NE,for use as a passive nature park with open space and for pedestrian activities;and WHEREAS,the City Council of the city of Marysville considers it in the public interest to place this project on its Comprehensive Plan Capital Improvement Plan for acquisition and development in accordance with an interlocal agreement to be developed with Snohomish county Parks Department;NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.The Director of Parks and Recreation is authorized to make a formal joint application with Snohomish County Parks Department to the Snohomish County Conservation Futures Fund for funding assistance. 2.Any funding assistance so received is to be used in the acquisition of: a. Window. RESOLUTION - 1 I_vl/park..res Fifteen (15)acres known as Mother Nature's .. b.Twenty-five (25)acres under various private ownership surrounding Mother Nature's Window. 3.The City's share of the project will be derived from the Growth Management Fund not to exceed $100,000.00. 4.The city of Marysville does hereby certify that it will be responsible in providing management assistance and development assistance should the acquisition be accomplished. 5.Any property acquired with financial aid through the Conservation Futures Fund shall be placed in use as an outdoor recreation facility and be retained in such use in perpetuity unless otherwise provided and agreed to by the Marysville city Council and Snohomish County Council. 6.This resolution shall become part of a formal ;application to the Conservation Futures Fund for 1992-1993. 7.Adequate notification has been given to the public that will ensure an opportunity for input in designing the Comprehensive Park Plan Capital Improvement Program. 8.The city will negotiate an interlocal agreement with Snohomish County sharing ownership and management of said property if granted financial aid prior to commitment of city funds. 9.The Snohomish County Parks Department will be the lead agency in the planning and application process to the Snohomish County Conservation Futures Fund. 10.Any party aggrieved by this resolution shall have the right to file an application for a writ of certiorari in Snohomish County Superior Court;PROVIDED,that the application must be filed and served within 20 days of the date of this resolution. ~PASSED by t~council and APPROVED by the Mayor this Y".=....-_.'_day of 3 ~<I 1992.
