HomeMy WebLinkAboutR-1573 - Granting a utility variance for the Marysville School District property located at 152nd Street NE and 51st Avenue NE Marysville WashingtonCIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION No./~7-3 A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FOR THE MARYSVILLE SCHOOL DISTRICT PROPERTY LOCATED AT 152ND STREET N.E.AND 51ST AVENUE N.E., MARYSVILLE,WASHINGTON. WHEREAS,on January 16,1992 the Marysville School District applied for a utility variance for water and sewer connections for property located at 152nd Street N.E.and 51st Avenue N.E., Marysville,Washington on property located outside of the city's RUSA boundaries;and WHEREAS,on August 24,1992 the City Council of the city of Marysville held a pUblic meeting concerning the variance application and made the following findings: 1.The property is located within Marysville's water service area as identified in the North Snohomish County Coordinated Water System Plan. 2.As a result of the applicant's property being located within the City's Coordinated Water System Plan,it will Ultimately be served utilities by the City of Marysville. 3. completed proposal. The Everett/Marysville water supply pipeline is now and is available to service the area of the applicant's 4.The sewer collection system infrastructure needed to serve the sUbject property is already in place.The proposed junior high school is projected to house 860 students and faculty.It is projected that increased BODs loading to the wastewater treatment plant as a result of connecting the school will be approximately 34 pounds of BODs'equivalent to 57 REU's. 5.The construction and design of an on-site sewage disposal system would not be cost effective for this applicant. 6.The applicant's request is consistent with the long range sewer utility planning efforts of the city of Marysville. 7.Based upon information provided by the Marysville School District,it is apparent that there is a dire pUblic need for this school facility.The proposed school facility is a public use which is essential for the health,safety and welfare of the Marysville School District and the public in general. 8.The City of Marysville has a 12-inch water main and a 24-inch sanitary sewer main located in 51st Avenue N.E.which fronts the east side of the proposed site. RESOLUTION - 1 Imsvl/schdist2.res .;-~"..," 9.Adjacent utilities (Snohomish County PUD and Arlington) do not have water or sewer mains in the vicinity of the proposal. BASED UPON THE ABOVE FINDINGS OF FACT,THE CITY COUNCIL MAKES THE FOLLOWING CONCLUSIONS: 1.The above circumstances constitute exceptional or extraordinary circumstances or conditions applying to the subject property or as to the intended use thereof that do not apply generally to other properties in the same vicinity. 2. enjoyment possessed The variance is necessary for the preservation and of a substantial property right of the applicant by owners of other properties in the same vicinity. 3.The authorization of the variance will not be materially detrimental to the public interest,welfare or the environment. 4.The granting of the variance will not be inconsistent with the long range plans of the City utility system,or jeopardize utility availability for the properties within the City limits. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: The variance for the applicant's connection to city sewer and water is hereby granted subject to the following conditions: 1.Sewer service will not be provided to the site until the completion of the current wastewater treatment plant upgrade. 2. agreeing prior to The Marysville School District shall execute a covenant not to protest the annexation of the subject property service of water or sewer by the city of Marysville. Any party aggrieved by this resolution shall have the right to file an application for a writ of certiorari in Snohomish County Superior Court;PROVIDED,that the application must be filed and served within 20 days of the date of this resolution. r~PASSED bY~OUncil and APPROVED by the Mayor ~day of ~,1992.
