A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY
VARIANCE FOR THE BRENMAR BUILDERS,INC.PROPERTY LOCATED
WEST OF 1210 LAKEWOOD ROAD,STANWOOD,WASHINGTON.
WHEREAS,on June 26,1992 Brenmar Builders,Inc.applied for
a utility variance for a water connection without sewer
connection for property located west of 1210 Lakewood Road,
Stanwood,Washington on property located outside of the City's
RUSA boundaries;and
WHEREAS,on August 24,1992 the City Council of the city of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.The property is located within the Seven Lakes Water
Association's designated Coordinated Water System Plan boundary.
2.The applicant has submitted a letter from the manager
of the Seven Lakes Water Association releasing the sUbject
property from their potential service area.
3.The property in question is fronted by a 12-inch
diameter city of Marysville water line.
4.On JUly 10,1989 the city Council previously granted
conditional approval of this request.Each of the City's
findings are hereby incorporated by this reference.
BASED UPON THE ABOVE-REFERENCED FINDINGS,THE CITY COUNCIL
MAKES THE FOLLOWING CONCLUSIONS:
1.The above circumstances constitute exceptional or
extraordinary circumstances or conditions applying to the subject
property or as to the intended use thereof that do not apply
generally to other properties in the same vicinity.
2.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same vicinity.
3.The authorization of the variance will not be
materially detrimental to the pUblic interest,welfare or the
environment.

4.The granting of the variance will not be inconsistent
with the long range plans of the city utility system,or

jeopardize utility availability for the properties within the
City limits.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
The variance for the applicant's connection to city water is
hereby granted sUbject to the condition that the variance shall
be for one single-family residence only.
Any party aggrieved by this resolution shall have the right
to file an application for a writ of certiorari in Snohomish
County Superior Court;PROVIDED,that the application must be
filed and served within 20 days of the date of this resolution.
