HomeMy WebLinkAboutR-1577 - Affirming the decision of the hearing examiner and approving an application for a Shoreline substantial development permit to allow the construction o-----_._--------------------------------------- ~. ;/-~ /-Q~ CIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO.1'577 A RESOLUTION OF THE CITY OF MARYSVILLE AFFIRMING THE DECISION OF THE HEARING EXAMINER AND APPROVING AN APPLICATION FOR A SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT TO ALLOW THE CONSTRUCTION OF A 16,000 SQUARE FOOT LIGHT MANUFACTURING BUILDING FOR A PROPERTY OWNED BY BRUCE NYBLOD. WHEREAS,Bruce Nyblod owns certain real property located northeast of 56th Place N.E.and 48th Drive N.E.,westerly of Allen Creek known as Lot 4,BrashIer Industrial Park,Division 2, in the City of Marysville;and WHEREAS,Bruce Nyblod and Dan King applied to the City for a Shoreline Substantial Development Permit to allow the construction of a 16,000 square foot light manufacturing building under File No.PA9205021;and WHEREAS,the City Hearing Examiner held a public hearing on said application for a Shoreline Substantial Development Permit on August 13,1992 and adopted Findings of Fact,Conclusions and a Recommendation approving the application SUbject to six (6) conditions;and WHEREAS,the Marysville city Council held a public meeting on said application for a Shoreline Substantial Development Permit on September 8,1992 and concurred with the Findings of Fact,Conclusions and Recommendation of the Hearing Examiner; NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: section 1.The Findings of Fact,Conclusions and Recommendation of the Hearing Examiner with respect to the above- referenced application for a Shoreline SUbstantial Development Permit are hereby approved. Section 2.The Shoreline Substantial Development Permit for the above-described property shall be perpetually conditioned upon strict compliance with each of the conditions set forth in the Recommendation of the Hearing Examiner.Violation of any of the conditions of said decision or violation of any pertinent city ordinance relating to the property may result in revocation of the Shoreline Substantial Development Permit and/or may result in enforcement action being brought by the city. RESOLUTION - 1 /msv/nyblod.res ..'1"- ".;.0 section 3.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior court of Snohomish County by writ of Certiorari,writ of Prohibition, or writ of Mandamus within fifteen (15)calendar days after the passage of this resolution. ~PASSED by the city council and APPROVED by the Mayor this 1'1,</"day of September,1992.
