A RESOLUTION OF THE CITY OF MARYSVILLE AFFIRMING THE
DECISION OF THE HEARING EXAMINER AND APPROVING A
CONDITIONAL USE PERMIT AND SHORELINE MANAGEMENT PERMIT
FOR PROPERTY OWNED BY OLE LIND BORG FOR USE AS A MOOSE
LODGE,SUBJECT TO CONDITIONS.
WHEREAS,Ole Lindborg owns certain real property located
between SR 528 and Sunnyside Boulevard on the west side of Allen
Creek in the city of Marysville;and
WHEREAS,applicant Marysville Moose Lodge No.1845 applied
to the city for a Conditional Use Permit and a Shoreline
Management Permit to construct an 8,854-square-foot building with
associated parking,for use as a Moose Lodge in the RS-7200 zone;
and
WHEREAS,the Hearing Examiner held a public hearing on July
9,1992 and adopted Findings of Fact,Conclusions and a
Recommendation approving the Conditional Use Permit and Shoreline
Management Permit,sUbject to fifteen (15)conditions;and
WHEREAS,the City Council held a pUblic hearing on September
14,1992 and accepted further testimony from City staff,the
applicant,ankd the pUblic,and having been fully advised in the
premises,the city Council concurred with the Findings of Fact,
Conclusions and Recommendation of the Hearing Examiner;NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The Findings of Fact,Conclusions and Recommendation of
the Hearing Examiner with respect to the above-referenced
Conditional Use Permit and Shoreline Management Permit under File
No.9204016 is hereby approved.
2.The Conditional Use Permit and Shoreline Management
Permit for the above-described property shall be perpetually
conditioned upon strict compliance with each of the conditions
set forth in the Recommendation of the Hearing Examiner.
Violation of any of the conditions of said decision may result in
revocation of the Conditional Use Permit and/or Shoreline
Management Permit or enforcement action being brought by the City
under applicable provisions of City Code.

3.The City Planner is hereby directed to forward the
Shoreline Management Permit to the Washington State Department of
Ecology for review.
4.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by writ of Certiorari,writ of Prohibition,or
Writ of Mandamus within fifteen (15)calendar days after the
passage of this resolution.
