HomeMy WebLinkAboutR-1584 - Granting a variance for the Myron Gemmer Property for a water connection without sewer connection at 1507 NE 172nd Street Arlington Washington.---------------------------------------------_._- CITY OF MARYSVILLE Marysville,washington RESOLUTION NO.1'5"8''1 A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A VARIANCE FOR THE MYRON GEMMER PROPERTY FOR A WATER CONNECTION WITHOUT SEWER CONNECTION AT 1507 N.E.172ND STREET,ARLINGTON,WASHINGTON. WHEREAS,on January 13,1992 the city granted Myron Gemmer a water connection without sewer connection for the property located at 1507,N.E.172nd Street,Arlington,Washington to allow connection to a fire hydrant/sprinkler system for commercial use; and WHEREAS,pursuant to Resolution No.1520,said variance expired on July 13,1992;and WHEREAS,Myron Gemmer has reapplied for a variance for said property seeking a water connection without also connecting to sewer for said fire hydrant/sprinkler system;and WHEREAS,Myron Gemmer also applied for a new utility variance for a water connection without sewer for a new single- family residence being constructed on the property immediately to the west of 1507 N.E.172nd Street,Arlington,Washington;and WHEREAS,on September 28,1992 the City Council of the City of Marysville held a pUblic meeting concerning the variance applications and made the following findings: 1.Each of the findings previously set forth in Resolution No.1520 continue to be applicable,and as such,said findings are incorporated herein by this reference. 2.The applicant's request is consistent with the long- range plans of the city of Marysville water utility. 3. residence purposes. The new variance is requested for one single-family and is not intended for development or sUbdivision 4.An adjacent parcel of property previously owned by the applicant is served by city water. 5.The above circumstances constitute exceptional or extraordinary circumstances or conditions applying to the subject property that do not apply generally to other properties in the same vicinity. RESOLUTION - 1 Imvl/gemmer2.res 6. enjoyment possessed The variance is necessary for the preservation and of a substantial property right of the applicant by owners of other properties in the same vicinity. 7.The authorization of the variance will not be materially detrimental to the pUblic interest,welfare or the environment. 8.The granting of the variance will not be inconsistent with the long-range plans of the city utility system or jeopardize utility availability for properties within the city limits. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,AS FOLLOWS: The variance for the applicant's connection to city water without City sewer is hereby GRANTED sUbject to the following conditions: 1.The variance shall be limited to connection for the purpose of fire protection and sprinklering purposes for a commercial building. 2.The variance shall also be granted for the property immediately to the west of 1507 N.E.172nd Street,Arlington, Washington for one single-family residence,entire parcel owned by the applicant. 3.Both of the above-referenced variances shall become void if the water connection is not completed within six months of October 6,1992. Any party aggrieved by this resolution shall have the right to file an application for a writ of Certiorari in Snohomish County Superior Court;PROVIDED,that the application must be filed and served within twenty (20)days of the date of this Resolution.
