A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A
UTILITY VARIANCE FOR THE GREGORY PARTRIDGE PROPERTY
LOCATED AT 5623 -86TH PLACE N.E.,MARYSVILLE,
WASHINGTON.
WHEREAS,on October 30,1992 Gregory Partridge applied for a
utility variance for a water connection without sewer for one
single-family dwelling located at 4523 -86th Place N.E.,
Marysville,Washington;and
WHEREAS,on January 11,1993 the city Council of the City of
Marysville held a pUblic meeting concerning the variance
application and made the following findings:
1.The applicant's property is within the area defined by
the City's RUSA boundary.
2.The property is located within ULID #18.
3.On December 7,1992 the City Council denied the
application without prejudice,pending information from the
Snohomish County Health District indicating no objection to the
installation of an on-site sewage disposal system on the subject
properties.The Snohomish Health District did provide a letter
dated December 16,1992 indicating no objection to the
installation of an on-site sewage disposal system.
4.While sanitary sewer is available within 200 feet of
the subject property,the construction of the same,in this case,
would create a financial hardship on the applicant.
5.Connection to the City water utility will not adversely
affect the ULID #18 project.
6.The variance is for one single-family residence for the
applicant's entire lot and is not for further development
purposes.
7.The above circumstances constitute exceptional or
extraordinary circumstances or conditions applying to the subject
property that do not apply generally to other properties in the
same vicinity.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same vicinity.
9.The authorization of the variance will not be
materially detrimental to the pUblic interest,welfare or the
environment.
10.The granting of the variance will not be inconsistent
with the long-range plans of the City utility system or
jeopardize utility availability for properties within the City
limits.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON,AS FOLLOWS:
The variance for the applicant's connection to City water
without city sewer is hereby GRANTED subject to the following
conditions:
1.The variance shall be for one single-family residence
for the entire lot owned by the applicant.
2.The applicant shall sign an agreement not to protest
the formation of a ULID for sewer,if and when sewer is to be
constructed across the frontage of applicant's property.
3.This variance shall expire six months after the passage
of this resolution.
