A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY
VARIANCE FOR THE SNO-ISLE REGIONAL LIBRARY LOCATED AT
7312 - 35TH AVENUE N.E.,MARYSVILLE,WASHINGTON.
WHEREAS,on February 2,1993,the Sno-Isle Regional Library
applied for a utility variance for a sewer connection for
property located at 7312 -35th Avenue N.E.,Marysville,
Washington,said property being located outside of the City's
RUSA boundaries;and
WHEREAS,on April 5,1993 the City Council of the city of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.The applicant's property is near the City's RUSA
boundary and is in reasonable proximity to existing City sewer
mains.Due to overcrowding and lack of available space,the
applicant is in need of expanding its building.Continued use of
the applicant's on-site septic system will render expansion on
the applicant's site difficult and potentially infeasible due to
site constraints.
2.The applicant is a public facility which serves the
citizens of Marysville and Snohomish and Island counties.
3.The applicant·s facility is already served by city
water.The building which is presently on the site was
constructed prior to adoption of the City's RUSA plan,and as
such a variance for provision of water was not necessary.
4.While the city does not presently have long range plans
to serve utilities in the area of the applicant's property,
connection to city utilities will not be inconsistent with the
long range sewer utility planning efforts of the city so long as
the sewer service is dedicated to this pUblic facility only.
5.The above circumstances constitute exceptional or
extraordinary circumstances or conditions applying to the subject
property that do not apply generally to other properties in the
same vicinity.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same vicinity.
7.The authorization of the variance will not be
materially detrimental to the public interest,welfare or the
environment.

8.With the limitations provided below,the granting of
the variance will not be inconsistent with the long range plans
of the City utility system or jeopardize utility availability for
properties within the City limits.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The variance for the applicant's connection to city
sewer is hereby granted subject to the following conditions:
a.The construction of the sewer servicing the
applicant's property shall be a "tight line"system.There
shall be no other connections to the sewer line servicing
the applicant's property by any other property except the
applicant's.
b.This variance shall be valid for a period of12Mooih~from the date of this resolution,and shall
automatically expire unless the applicant has connected to
the City sewer system with in said one-year period.
2.Any party aggrieved by this resolution shall have the
right to file an application for a writ of certiorari in
Snohomish County Superior Court;PROVIDED,that the application
must be filed and served within 20 days of the date of this
resolution.
~PASSED by the city Council and APPROVED by the Mayor this
