A RESOLUTION OF THE CITY OF MARYSVILLE AFFIRMING THE
DECISION OF THE HEARING EXAMINER AND GRANTING A
CONDITIONAL USE PERMIT FOR DWAYNE LANE'S DODGE,SUBJECT
TO CONDITIONS.
WHEREAS,Dwayne Lane's Dodge applied to the City for a
conditional use permit to allow weekend care sales to be located
in the K-Mart parking lot at 9623 State Avenue,Marysville,
Washington;and
WHEREAS,on April 22,1993 the City Hearing Examiner held a
public hearing and adopted Findings of Fact,Conclusions and a
Recommendation approving the conditional use permit sUbject to
four conditions;and
WHEREAS,the Marysville City Council held a pUblic meeting
on said conditional use permit on May 24,1993 and concurred with
the Findings of Fact,Conclusions and Recommendation of the
Hearing Examiner subject to a clarification of condition number 4
in the Hearing Examiner's Recommendation;
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON,AS FOLLOWS:
1.The Findings of Fact,Conclusions and Recommendation of
the Hearing Examiner,except as otherwise modified herein,with
respect to the above-referenced conditional use permit under file
number PA 9212064,is hereby approved.
2.Condition number 4 of the Hearing Examiner's
Recommendation is hereby amended to read as follows:
This permit shall be valid for one year,to
be reviewed annually for extension through
administrative review by the Planning
Department.
3.The conditional use permit for the above-described
property shall be conditioned upon strict compliance with each of
the conditions set forth in the Recommendation of the Hearing
Examiner.Violation of any of the conditions of said decision or
upon recommendation of revocation by the Marysville Planning
Department may result in revocation of the conditional use permit
or enforcement action being brought by the city.
4.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of

Snohomish County by writ of certiorari,writ of prohibition or
writ of mandamus within fifteen (15)calendar days after the
passage of this resolution.
IJPASSED by the city Council and APPROVED by the Mayor this
