A RESOLUTION OF THE CITY OF MARYSVILLE DENYING,WITHOUT
PREJUDICE,A UTILITY VARIANCE FOR WATER CONNECTIONS
WITHOUT SEWER FOR JIM MULLIGAN FOR PROPERTY LOCATED AT
3505 - 188TH STREET N.E.
WHEREAS,on February 2,1993 Jim Mulligan applied to the
City for a utility variance requesting water connections without
sewer for 40 single-family residences located at 3505 -188th
Street N.E.j and
WHEREAS,on May 24,1993 the Marysville City Council held a
public meeting to consider said variance requestj and
WHEREAS,the Marysville City Council based upon all
available information,including the city Staff report and all
written materials submitted therewith,makes the following
findings:
1.The applicant's property is within the Arlington
service area per the North Snohomish County Coordinated Water
System Plan.

The applicant has submitted a letter from the city of
Public Works Department stating that Arlington is
provide service to the site at this time.
3.Subject property is outside of the present Marysville
service area per the North Snohomish County Coordinated Water
System Plan and is outside of the City's RUSA area.
4.The applicant's proposal is for 40 single-family
residences and does not involve already existing structures or
structures that are serviced by an already existing standard
water source.
5.The city has not at this date completed an update to
its Comprehensive Plan for the area.
6.There are not exceptional or extraordinary
circumstances or conditions applying to the subject property that
do not apply to other properties within the same vicinity.
7.Authorization of the variance could become materially
detrimental to the public interest,welfare or the environment as
a result of the surface water treatment rule promulgated by the
State of Washington,which will take effect in 1995.

8.It is unclear whether the variance request is
consistent with the long-range plans of the City of Marysville in
that the subject property presently falls within the Arlington
service area,the surface water treatment rule may impact the
City's ability to service the area where the applicant's property
is located,and the City's Comprehensive Plan has not yet been
updated.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON,AS FOLLOWS:
Based upon the foregoing findings,the applicant's request
for utility variance for water connections without sewer is
hereby DENIED without prejudice.The applicant may resubmit its
location at such time as the city has completed its update to the
water system Comprehensive Plan without further fee.
Any party aggrieved by this resolution shall have the right
to file an application for a writ of Certiorari in Snohomish
County Superior Court;PROVIDED,that the application must be
filed and served within twenty (20)days of the date of this
Resolution.
