A RESOLUTION OF THE CITY OF MARYSVILLE DENYING WITHOUT
PREJUDICE A VARIANCE FOR WATER AND SEWER CONNECTIONS
FOR JACK AND MARY FAUCETT FOR PROPERTY LOCATED NORTH OF
172ND STREET AND WEST OF SMOKEY POINT BOULEVARD,
ARLINGTON,WASHINGTON.
WHEREAS,on June 4,1993 Jack and Mary Faucett and Jim and
Diane Faucett applied for a utility variance for water and sewer
hookups for approximately 280 connections for water and sewer for
property located north of 172nd Street and west of Smokey Point
Boulevard,Arlington,Washington,said property being located
outside of the City's RUSA boundaries;and
WHEREAS,on July 26,1993,the City Council of the City of
Marysville held a pUblic meeting concerning the variance
application and made the following findings:
1.The applicants'property is outside of the city's RUSA
boundary.
2.The subject property is outside of the CWSP for
Marysville and falls within the Arlington CWSP.
3.While the city of Marysville does provide water and
sewer to the Plat of Lakewood Commons,which is located to the
south of the proposed site,the depth of the sanitary sewer at
the north boundary of the Lakewood Commons is approximately seven
feet and could provide gravity service to only a portion of the
proposed plat.
4.The area is sUbject to potential service by the Raney
well and Edward Springs system.The RUSA committee has studied
the issue and has recommended that the City Council not authorize
any connections to new plats outside of the CWSP planning area
until the city's water comprehensive plan is completed.
5.In light of the above,at this time,the four criteria
for granting a variance as set forth in the Marysville Municipal
Code cannot be met.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON,AS FOLLOWS:
The variance for the applicants'connection to city sewer
and water for approximately 280 lots is hereby DENIED without

prejudice for a period of one year from the date of this
resolution.Within the one-year period of time,the applicant
may reapply for said variance and the fee for said application
shall be waived.
Any party aggrieved by this resolution shall have the right
to file an application for a writ of Certiorari in Snohomish
County Superior Court;PROVIDED,that the application must be
filed and served within twenty (20)days of the date of this
Resolution.
PASSED by the City Council and APPROVED by the Mayor this;J.~day of August,1993.
