HomeMy WebLinkAboutR-1646 - Denying without prejudice a utility variance for property owned by HKS Partnerhsip for property located between 2500 and 2700 169th Street NE MarysvilCIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO.1("'((,, A RESOLUTION OF THE CITY OF MARYSVILLE DENYING,WITHOUT PREJUDICE, A UTILITY VARIANCE FOR PROPERTY OWNED BY HKS PARTNERSHIP FOR PROPERTY LOCATED BETWEEN 2500 AND 2700 l69TH STREET N.E.,MARYSVILLE,WASHINGTON. WHEREAS,on september 23,1993 HKS partnership applied for a utility variance for sewer and water connections for property located between 2500 and 2700 -169th Street N.E.,Marysville, Washington;and WHEREAS,on October 25,1993 the City Council of the city of Marysville held a pUblic meeting concerning the variance application and made the following findings: 1.The applicant's property is outside of the City's RUSA boundary but within the CWSP boundary. 2.There is an eight-inch water main in 169th Street N.E. which runs on the north side of the proposed site.Water service in this vicinity is a part of the Edward Springs and Stillaguamish well system.The future use of said systems is presently under stUdy. 3.The city is in the process of reviewing and updating its water comprehensive plan for the area where the applicant's property is located.The city has determined that there shall be no new connections for water in this area,at least until the comprehensive plan is completed.At that time,a review may be made as to whether new water services should be available in the area of the applicant's property. 4.There is a twelve-inch gravity sewer line at 169th Street N.E.and 27th Avenue.However,variance requests for sewer in this vicinity have been denied due to the limited capacity of the existing downstream system which is a part of ULID #3.The applicant's request for 58 sewer connections WOUld, at this time,be inconsistent with the capacity limitations of the existing collection system. 5.While the above circumstances fail to meet the variance criteria set forth in MMC l4.32.060(d),in light of the fact that the City is presently reviewing and updating its water comprehensive plan,the application should be denied without prejudice. RESOLUTION - 1 Imvl/hks.res ,~'~.~,oil ., NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,AS FOLLOWS: The variance for the applicant's request for utilities is hereby DENIED without prejudice,pending the completion of the city's comprehensive water plan.The applicant may,for the six- month period ending April 30,1994,renew its request for this variance without payment of an additional application fee. Any party aggrieved by this resolution shall have the right to file an application for a writ of Certiorari in Snohomish County Superior Court;PROVIDED,that the application must be filed and served within twenty (20)days of the date of this Resolution.
