HomeMy WebLinkAboutR-1647 - Granting a conditional use permit for property owned by the YMCA subject to conditions'" .> CIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO./"'1'7 A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY OWNED BY THE YMCA SUBJECT TO CONDITIONS. WHEREAS,THE YMCA owns certain real property located on the north side of SR 528,west of 60th Drive N.E.,Lot of City of Marysville Short Plat No.92-03;and WHEREAS,THE YMCA applied to the city for a Conditional Use Permit to construct a 59,000-square-foot YMCA building and a 3,000-square-foot Food Bank Building;and WHEREAS,the city Hearing Examiner held a public hearing on September 9,1993 and adopted Findings of Fact,Conclusions and a Recommendation approving the Conditional Use Permit subject to 11 conditions;and WHEREAS,the city Council held a public meeting on said Conditional Use Permit on October 25,1993 and concurred with the Findings of Fact,Conclusions and Recommendation of the Hearing Examiner;NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.Subject to paragraph 2 below,the Findings of Fact, Conclusions and Recommendation of the Hearing Examiner with respect to the above-referenced Conditional Use Permit under File No.PA 93-4014 is hereby approved. 2.Condition number 11 of the Hearing Examiner shall be amended and clarified to read as follows: The one-year time frame to obtain a building permit shall commence from the date of binding site plan approval for each phase; provided,a one-year extension may be granted upon written request and upon showing substantial progress towards completion of the project. 3.The Conditional Use Permit for the above-described property shall be perpetually conditioned upon strict compliance with each of the conditions set forth in the Recommendation of the Hearing Examiner.Violation of any of the conditions of said decision may result in revocation of the Conditional Use Permit or enforcement action being brought by the City.
