A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A
CONDITIONAL USE PERMIT AND VARIANCE TO PRIVATE ROAD
STANDARDS FOR PROPERTY OWNED BY JOEL HYLBACK SUBJECT TO
CONDITIONS.
WHEREAS,JOEL HYLBACK owns certain real property located
10102 -42nd Avenue N.E.,in the City of Marysville;and
WHEREAS,JOEL HYLBACK applied to the City for a Conditional
Use Permit to construct four duplexes on proposed Short Plat 93-
002 and a variance from the city's private road standards;and
WHEREAS,the City Hearing Examiner held a public hearing on
October 7,1993 and adopted Findings of Fact,Conclusions and a
Recommendation approving the Conditional Use Permit and variance
subject to five (5)conditions;and
WHEREAS,the City Council held a public meeting on said
Conditional Use Permit and variance on November 1,1993 and
concurred with the Findings of Fact,Conclusions and
Recommendation of the Hearing Examiner;NOW,THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The Findings of Fact,Conclusions and Recommendation of
the Hearing Examiner with respect to the above-referenced
Conditional Use Permit under File No.PA 9304015 is hereby
approved.
2.The Conditional Use Permit and variance for the above-
described property shall be perpetually conditioned upon strict
compliance with each of the conditions set forth in the
Recommendation of the Hearing Examiner.Violation of any of the
conditions of said decision may result in revocation of the
Conditional Use Permit and variance or enforcement action being
brought by the city.
3.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by Writ of Certiorari,writ of Prohibition,or
writ of Mandamus within fifteen (15)calendar days after the
passage of this resolution.
