A RESOLUTION OF THE CITY OF MARYSVILLE AFFIRMING THE
DECISION OF THE HEARING EXAMINER AND GRANTING
PRELIMINARY PLAT APPROVAL,A PRIVATE ROAD VARIANCE,AND
CONDITIONAL USE PERMIT FOR PROPERTY OWNED BY ROBERT
ALDRIDGE FOR THE PRELIMINARY PLAT OF GROVE STREET.
WHEREAS,Robert Aldridge owns approximately 2.75 acres
located on the northwest side of Grove street,across from the
intersection of 74th street N.E.;and
WHEREAS,Robert Aldridge applied to the City for preliminary
plat approval,a private road variance and conditional use permit
under File No.PA 9303007;and
WHEREAS,the City Hearing Examiner held a pUblic hearing on
said preliminary plat,private road variance and conditional use
permit on August 19,1993,and adopted Findings of Fact,
Conclusions and a recommendation approving the preliminary plat,
private road variance and conditional use permit,SUbject to
fifteen (15)conditions;and
WHEREAS,on September 27,1993 a public meeting was held by
the Marysville City Council to consider the applicant's request,
and issues were raised by adjacent property owners concerning
storm water runoff,wetlands,wild life,traffic,parking,views,
crime and growth.As a result,the City Council set a pUblic
hearing for November 8,1993 to receive pUblic testimony;and
WHEREAS,on November 8,1993 the Marysville City Council
held a pUblic hearing and received testimony from Staff,the
applicant and the public,and as a result of considering the
entire record,inclUding all materials submitted to the Council
in connection therewith,and all testimony,the Council concurred
with the Findings,Conclusions and recommendation of the Hearing
Examiner;
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON,AS FOLLOWS:
1.The Findings of Fact,Conclusions and recommendation of
the Hearing Examiner with respect to the above-referenced
preliminary plat,private road variance and conditional use
permit are hereby APPROVED,with the exception that reference in
the Hearing Examiner's condition number I to "T.I.P.No.1"is
hereby deleted for the reason that the applicant's property is
not within the boundary for T.I.P.No.1.

2.The approval of the preliminary plat,private road
variance and conditional use permit shall be perpetually
conditioned upon strict compliance with each of the conditions
set forth in the recommendation of the Hearing Examiner.
Violation of any of the conditions of said decision may result in
revocation of the permits granted herein and/or enforcement
action being brought by the city.
3.This decision shall be final and conclusive with the
right of appeal of any aggrieved party to the Superior court of
Snohomish County by Writ of Certiorari,Writ of Prohibition or
Writ of Mandamus within fifteen (15)calendar days after the
passage of this Resolution.
PASSED by the city Council and APPROVED by the Mayor this
