HomeMy WebLinkAboutR-1662 - Granting a utility variance for the Carrie Newcomb property located at 3320 186th Place NE Arlington WashingtonCIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO.J'~;L A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FOR THE CARRIE NEWCOMB PROPERTY LOCATED AT 3320 - 186TH PLACE N.E.,ARLINGTON,WASHINGTON. WHEREAS,on November 29,1993,Carrie Newcomb applied for a utility variance for a water connection for property located at 3320 -186th Place N.E.,Arlington,Washington;and WHEREAS,on December 13,1993 the city Council of the city of Marysville held a public meeting concerning the variance application and made the following findings: 1.The applicant's property is located outside of the City's RUSA and CWSP boundaries.It is also located outside of the Interim Urban Growth Boundary as established by Snohomish County. 2.There is existing city water available on 186th Place N.E. 3.The property lies within the Arlington water utility service area,however,the CWSP has not been updated and finalized in this area and the city of Arlington has not updated its comprehensive plan to reflect the requirements of the CWSP. At this time,the City of Arlington is unable to provide water service to this address. 4.Public sewer is not available within 200 feet of the applicant's property. 5.The applicant has established a bona fide hardship situation,as she presently has no water available. 6.The city of Arlington has provided a letter dated November 22,1993 which is incorporated by this reference that specifies that it is unable to provide water service to the applicant's property at this time. 7.The variance is for one single-family residence for the applicant's entire property and is not for development purposes. 8.The above circumstances constitute exceptional or extraordinary circumstances or conditions applying to the sUbject property that do not apply generally to other properties in the same vicinity. 9.The variance is necessary for the preservation and enjoyment of a substantial property right of the applicant RESOLUTION - 1 Imsvl/newcomb.res possessed by owners of other properties in the same vicinity. 10.The authorization of the variance will not be materially detrimental to the public interest,welfare,or the environment. 11.The granting of the variance will not be inconsistent with the long-range plans of the City utility system,or jeopardize utility availability for properties within the City limits. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: The variance for the applicant's connection to City sewer and water is hereby granted sUbject to the condition that the variance shall be for one single-family residence for the applicant's entire parcel.The applicant shall comply with all City Code requirements,including,but not limited to,all connection fees,frontage requirements,and capital improvement fees. Any party aggrieved by this resolution shall have the right to file an application for a writ of certiorari in Snohomish County Superior Court;PROVIDED,that the application must be filed and served within 20 days of the date of this resolution. ~PASSED by the city council and APPROVED by the Mayor this _";.)=-rct:J.=day of ~:,.<c'---__,1994.
