HomeMy WebLinkAboutR-1664 - Granting a utility variance for the Don Davis Property located at 5503 100th Street NE Marysville WashingtonCIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO./(,.,</ A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FOR THE DON DAVIS PROPERTY LOCATED AT 5503 - 100TH STREET N.E.,MARYSVILLE,WASHINGTON. WHEREAS,on November 9,1993,Don Davis applied for a utility variance for water and sewer connections for property located behind 5503 -100th Street N.E.,Marysville,Washington; and WHEREAS,on December 13,1993,the city Council of the city of Marysville held a pUblic meeting concerning the variance application and made the following findings: 1.The applicant's property is within the area defined by the city's Coordinated Water System Plan but it outside of the City's RUSA boundary. 2.There are existing water and sewer mains in a plat east of the Davis property known as the Village Green. 3. granted a water and The south half of parcel 2-036 owned by Mr. utility variance and is currently connected sewer. Davis was to city 4.The applicant was granted a utility variance on the property which is the subject of this application on February 10, 1986 but did not hook up to city water or sewer.The circumstances which gave rise to the ~arlier grant of a utility variance have not sUbstantially changed. 5.The variance is for one single-family residence for the applicant's property and is not for development purposes. 6.The above circumstances constitute exceptional or extraordinary circumstances or conditions applying to the sUbject property that do not apply generally to other properties in the same vicinity. 7. enjoyment possessed The variance is necessary for the preservation and of a substantial property right of the applicant by owners of other properties in the same vicinity. 8.The authorization of the variance will not be materially detrimental to the pUblic interest,welfare,or the environment. 9.The granting of the variance will not be inconsistent with the long-range plans of the City utility system,or RESOLUTION - 1 Imsvl/davis.res jeopardize utility availability for properties within the City limits. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: The variance for the applicant's connection to City sewer and water is hereby granted subject to the condition that the variance shall be for one single-family residence for the applicant's entire parcel.The applicant shall comply with all city Code requirements,including,but not limited to,all connection fees,frontage requirements,and capital improvement fees. Any party aggrieved by this resolution shall have the right to file an application for a writ of certiorari in Snohomish County Superior Court;PROVIDED,that the application must be filed and served within 20 days of the date of this resolution . ._~PASSED by the city council and APPROVED by the Mayor this 6vQ'day of ~j...__'1994.
