CITY OF MARYSVILLE Marysville,washington RESOLUTION NO.IC,70 A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FOR THE MICHAEL AND FRANCES REN PROPERTY LOCATED AT 7224 -35TH AVENUE N.E.,MARYSVILLE,WASHINGTON. WHEREAS,on December 27,1993,Michael and Frances Ren applied for a water connection without sewer for property located at 7224 -35th Avenue N.E.,Marysville,Washington;and WHEREAS,on February 7,1994 the City Council of the City of Marysville held a public meeting concerning the variance application and made the following findings: 1.The applicant's property is outside of the City's Rural Utility Service Area,CWSP and Interim Urban Growth Boundary. 2.There is presently an existing home at 7224 -35th Avenue N.E.,however,the owners would like to put a manufactured home on the property but the existing well does not have capacity to serve two homes. 3.Four homes have been granted utility variances in the past in the vicinity of the applicant's property. 4.There is an eight-inch C.I.water main in 35th Avenue N.E.which fronts the subject property. 5.In light of the above-referenced findings,the authorization of the variance for one single-family residence will not be materially detrimental to the public interest, welfare,or the environment. 6.In light of the above-referenced Findings,the granting of a variance in this case will not be inconsistent with the long-range plans of the City utility system or jeopardize utility availability for properties within the City limits,due to the fact that there is a request for one water connection only for a single-family residence. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: The variance for the applicant's connection to City water without sewer is hereby granted subject to the following conditions: a.The variance shall be for one single-family residence for the property owned by the applicant. RESOLUTION - 1 /rnsvl/ren.res ......-...... b.The applicant shall provide written confirmation from the Tulalip Tribes that they are unable to provide water service to the applicant. c.The applicant shall have connected to the City water utility within six months of the date of this resolution. Any party aggrieved by this resolution shall have the right to file an application for a writ of certiorari in Snohomish County Superior Court;PROVIDED,that the application must be filed and served within 20 days of the date of this resolution. ~~~ASSED by the City Council and APPROVED by the Mayor this ~o day of February,1994.
