A RESOLUTION OF THE CITY OF MARYSVILLE DENYING,WITHOUT
PREJUDICE,A UTILITY VARIANCE FOR GRANT OSBERG,D/B/A OSBERG
CONSTRUCTION COMPANY, FOR A PROPERTY LOCATED EAST OF 1-5 AND
SOUTH OF 188TH STREET N.E.
WHEREAS,on March 7,1994 Grant Osberg,d/b/a Osberg
Construction Company,applied for a water connection without
sewer for a property located east of 1-5 and south of 188th
Street N.E.;and
WHEREAS,on April 11,1994 the City Council of the City of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.The applicant has requested 30 water connections
without sewer for a 10-acre parcel which is proposed to be
subdivided into approximately 30 lots.
2.There currently exists a 10-inch force main in Smokey
Point Blvd.approximately 1,000 feet east of the site and an 8-
inch gravity main in 188th Street N.E.,approximately 1,500 feet
south of the site.
3.The subject site is outside of the city limits of
Marysville,outside of the City's RUSA boundary,outside of the
CWSP boundary,and outside of the IUGA boundary.
4.The subject property is within the study area for the
City's water comprehensive plan.
5.In light of the above-referenced findings,the granting
of a variance at this time would be inconsistent with the City's
utility plan.However,when the City's comprehensive water plan
is completed,the City will be in a better position to review the
applicant's request.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
The variance for the applicant's connection to City water
without sewer is hereby DENIED WITHOUT PREJUDICE.The applicant
may resubmit his request within a period of six (6)months from
the date of this resolution without repayment of the variance
application fee.

Any party aggrieved by this resolution shall have the right
to file an application for a writ of certiorari in Snohomish
County Superior Court;PROVIDED,that the application must be
filed and served within 20 days of the date of this resolution.
