HomeMy WebLinkAboutR-1684 - Granting a conditional use permit for property owned by Thomas and Helen Graham subject to conditions:~ CITY OF MARYSVILLE Marysville,Washington RESOLUTION NO./C~'T A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY OWNED BY THOMAS AND HELEN GRAHAM SUBJECT TO CONDITIONS. WHEREAS,Thomas and Helen Graham own certain real property located at the south side of 4th Street between Alder and Quinn in the City of Marysville;and WHEREAS,Thomas and Helen Graham applied to the City for a Conditional Use Permit to construct a two-story professional office building,including location of a sign;and WHEREAS,the City Hearing Examiner held a public hearing on March 10,1994 and adopted Findings of Fact,Conclusions and a Recommendation approving the Conditional Use Permit subject to \ thirteen (13)conditions;and WHEREAS,the City Council held a public hearing on said Conditional Use Permit on May 9,1994 to discuss the alley exit from the proposed parking,parking restrictions and site distance concerns along 4th Street,and the requirement for stortz adapters on the City fire hydrants;and WHEREAS,as a result of said public hearing,the City Council concurred with the Findings of Fact,Conclusions and Recommendation of the Hearing Examiner,and adopted additional conditions relating to the subject application;NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.The Findings of Fact,Conclusions and Recommendation of the Hearing Examiner with respect to the above-referenced Conditional Use Permit under File No.PA 9401001 is hereby approved. 2.As a result of the public hearing held by the City Council,the following additional conditions are hereby adopted: a.The applicant shall revise the parking to allow for access to and from the subject alley. b.The applicant shall be required to make improvements to said alley only along that part of the alley which is immediately adjacent to the applicant's property. RESOLUTION - 1 Imv/graham.res c.There shall be no requirement to provide for a stortz adapter. d.Parking shall be restricted along 4th Street within 30 feet of each side of the driveway to the applicant's property. 3.The Conditional Use Permit for the above-described property shall be perpetually conditioned upon strict compliance with each of the conditions set forth in the Recommendation of the Hearing Examiner and City Council.Violation of any of the conditions of said decision may result in revocation of the Conditional Use Permit or enforcement action being brought by the City. 4.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by Writ of Certiorari,Writ of Prohibition,or Writ of Mandamus within fifteen (15)calendar days after the passage of this resolution. ~PASSED by the City Council and APPROVED by the Mayor this ..13 day of May,1994.
