A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY
VARIANCE FOR CAMERON C.ELDER FOR PROPERTY LOCATED AT 18301 -
31STAVENUEN.E.,18311-31STAVENUE N.E., AND 18321-31STAVENUE
N.E., ARLINGTON,WASHINGTON.
WHEREAS,on May 19,1994 Cameron C.Elder applied for a
utility variance for three water connections without sewer for
three existing mobile homes located at 18301 -31st Avenue N.E.,
18311 -31st Avenue N.E.,and 18321 -31st Avenue N.E.,
Arlington,Washington;and
WHEREAS,on June 27,1994 the City Council of the City of
Marysville held a public meeting concerning the variance
application,and made the following findings:
1.The applicant's property is outside of the area defined
by the City's Coordinated Water System Plan.
2.The applicant's property is outside of the area defined
as the City's Interim Urban Growth Area.
3.The applicant's property is outside of the City's Rural
Utility Service Area.
4.The applicant's property is within the Utility Service
Area for the City of Arlington.However,the City of Arlington,
by letter dated May 10,1994,indicated that it would be unable
to provide water service to the applicant at this time.
5.The three mobile homes on the subject properties are
presently served by a private well located on the Stilly Senior
Center property which is adjacent thereto.Recent expansion of
the Center requires abandonment of the well which serves these
properties.The Stilly Senior Center is presently served by City
water with an existing main stubbed to the sites which are the
subject of this application.
6.By letter dated June 13,1994,the Snohomish Health
District has indicated that the subject well system has become
functionally obsolete and that nitrate contaminant exceeds the
maximum permissible level.The Snohomish Health District
recommended that persons not be allowed to drink the water.
7.The above-referenced circumstances constitute a public
health and safety hazard and an emergency condition which
justifies allowing connections to the above-referenced
properties.

8.In light of the above-referenced findings,the
applicant's request does meet the variance criteria set forth in
MMC 14.32.060.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
The variance for the applicant's connection to City water
without sewer is hereby granted,subject to the following
conditions:
1.That a covenant not to protest annexation to the City
of Marysville be executed for the subject property.
2.

for the above-referenced three single-family dwellings
Any party aggrieved by this resolution shall have the right
to file an application for a writ of certiorari in Snohomish
County Superior Court;PROVIDED,that the application must be
filed and served within 20 days of the date of this resolution.
PASSED by the City Council and APPROVED by the Mayor this
day of July,1994.
