HomeMy WebLinkAboutR-1709 - Declaring its intention to initiate the formation of LID No. 64 and to order the improvement of a portion of 67th Avenue NE and 88th Street NE and toCITY OF MARYSVILLE Marysville,Washington RESOLUTION NO.//09 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON,DECLARING ITSINTENTION TO INITIATE THE FORMATION OF LID NO.64 AND TO ORDER THE IMPROVEMENT OF A PORTION OF 67TH AVENUE N.E. AND 88TH STREET N.E.• AND TO CREATE A LOCAL IMPROVEMENT DISTRICT TO ASSESS THE COST AND EXPENSE OF CARRYING OUT SUCH IMPROVEMENTS AGAINST THE PROPERTIES SPECIALLY BENEFITTED THEREBY, AND NOTIFYING ALL PERSONS WHO DESIRE TO OBJECT TO THE IMPROVEMENTS TO APPEAR AND PRESENT THEIR OBJECTIONS AT A HEARING BEFORE THE CITY COUNCIL TO BEHELD ON NOVEMBER 28,1994. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: Section 1.It is the intention of the City Council of the City of Marysville,Washington,to order the improvement of the properties within the area described in Exhibit A,attached hereto and by this reference made a part hereof,by the reconstruction and improvement of 67th Avenue N.E.and 88th Street N.E.to consist of the following: •Widen 67th Avenue from Grace Street N.E.to 88th Street N.E. to four lanes with five lanes at the major intersections. •Widen 88th Street from 67th Avenue west to approximately Allen Creek to three lanes with four lanes at the intersection. •Installation of the curb,gutter and sidewalks on both sides of 88th Street and 67th Avenue. •Construction of the storm sewer system along 88th Street and 67th Avenue as required. •Acquisition of the right-of-way along 88th Street and 67th Avenue as necessary. All of the foregoing improvements shall be in accordance with the plans and specifications therefor prepared by Hammond, Collier &Wade-Livingstone Associates,Inc.,consulting engineers of the City,and may be modified by the City as long as such modification does not affect the purpose of the improvement. Section 2.The total estimated cost and expense of the improvements is declared to be approximately $1,308,750,of which RESOLUTION - 1 Imv/lid64.res ~,,.,'. approximately $117,650 is proposed to be paid by the City,as the cost of a fifth lane,and $1,191,100 of such improvements shall be borne by and assessed against the property specially benefitted by such improvements to be included in a local improvement district to be established embracing as nearly as practicable all the property specially benefitted by the improvements. Section 3.All persons who may desire to object to the improvements described herein are notified to appear and present such objections at a hearing before the City Council to be held in the Marysville Public Safety Center,1635 Grove Street, Marysville,Washington at 7:00 p.m.,local time,on November 28, 1994 at a regular meeting of the City Council then to be held at such time and place,which time and place are fixed for hearing all matters relating to the proposed improvements and all objections thereto and for determining the method of payment for those improvements.All persons who may desire to object thereto should appear and present their objections at such hearing.Any person who may desire to file a written protest with the City Council may do so within thirty (30)days after the date of passage of the ordinance ordering the improvement in the event the local improvement district is formed.Such written protest should be signed by the property owner and should include the legal description of the property for which the protest is filed and such protest should be delivered to the City Clerk. Section 4.The City Clerk is directed to give notice of such hearing by publication of this resolution of intention in at least two consecutive issues of the official newspaper of the City,or,if there is no official newspaper,in a newspaper of general circulation in the City,with the date of first publication to be at least fifteen (15)days prior to the date of such hearing;and to mail a notice of such hearing to the owners or reputed owners of property in the proposed assessment district,as shown on the tax rolls of the County Assessor at the address shown thereon,at least fifteen (15)days prior to such hearing.The notice shall set forth the nature of the proposed improvement,the total estimated cost,the portion of the total cost to be borne by the assessments,the estimated amount of the cost and expense of such improvement to be borne by the particular lot,tract or parcel,and the date and place of the hearing.
