A RESOLUTION OFTHE CITY OF MARYSVILLE AMENDING RESOLUTION 1690
RELATING TO AN APPLICATION FOR A UTILITY VARIANCE FOR PROPERTY
OWNED BY HKS PARTNERSHIP FOR PROPERTY LOCATED BETWEEN 2500
AND 2700 -169TH STREET N.E.,MARYSVILLE,WASHINGTON BY
EXTENDING THE TIME PERIOD WITHIN WHICH THE APPLICANT MAY RENEW
ITS REQUEST FOR A VARIANCE.
WHEREAS,on November 8,1993 the City Council of the City of
Marysville adopted Resolution 1646 denying without prejudice a
utility variance for property owned by HKS Partnership;and
WHEREAS,pursuant to Resolution 1646 the applicant was
entitled to renew its request for said variance within the six-
month period ending April 30,1994;and
WHEREAS,by Resolution 1690 the Marysville City Council
granted a further extension of time for renewal of the request
for variance for a period beginning May 1,1994 and ending
October 31,1994;and
WHEREAS,the applicant renewed its request for said
variance,and on December 12,1994 the Marysville City Council
considered said request;and
WHEREAS,the update to the City's Water Comprehensive Plan
has not yet been completed;and
WHEREAS,the City Council recognizes that the Growth
Management Act imposes the requirement to establish an urban
growth boundary within which urban densities and urban
infrastructure,including utilities,shall be encouraged,and
outside of which such utilities shall be discouraged;and
WHEREAS,the final urban growth boundary has not yet been
established by Snohomish County for the area in the vicinity of
the applicant's property;and
WHEREAS,at the December 12,1994 Council meeting,the
applicant raised several issues concerning the legal description,
service boundary and planned capacity for ULID No.11;and
WHEREAS,the.City has raised issues concerning the sewer
capacity relating to ULID No.3;NOW,THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MARYSVILLE,WASHINGTON AS FOLLOWS;

Resolution 1690 is hereby amended to extend the time period
within which the applicant may renew its request for a variance
without payment of an additional application fee for an
additional six-month period beginning November 1,1994 and ending
on April 30,1995.
The City's RUSA Committee and the City Engineer are directed
to meet with the applicant and its engineer to clarify the above-
described issues relating to ULIDs No.s 3 and 11.
Any party aggrieved by this resolution shall have the right
to file an application for a writ of certiorari in Snohomish
County Superior Court;PROVIDED,that the application must be
filed and served within 20 days of the date of this resolution.
PASSED by the City Council and APPROVED by the Mayor this
3rd day of January,1995.
