HomeMy WebLinkAboutR-1717 - Granting a Shoreline conditional use permit and height variance for property owned by Public Utility District No. 1 of Snohomish County (PUD) subject/ :··1c- CITY OF MARYSVILLE Marysville, Washington RESOLUTION NO.OJ7 A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A SHORELINE CONDITIONAL USE PERMIT AND HEIGHT VARIANCE FOR PROPERTY OWNED BY PUBLIC UTILITY DISTRICT NO. 1 OF SNOHOMISH COUNTY (PUD) SUBJECT TO CONDITIONS. WHEREAS,the PUD owns certain real property located on the South side of Ebey Slough along the 1-5 right of'way and the Burlington Northern Railroad right of way in the City of Marysville;and WHEREAS,the PUD applied to the City for a Shoreline Conditional Use Permit to construct a new double-circuit 115 kV transmission line;and WHEREAS,the City Hearing Examiner held a public hearing on November 17,1994 and adopted Findings of Fact,Conclusions and a Recommendation approving the Shoreline Conditional Use Permit and height variance subject to two conditions;and WHEREAS,the City Council held a public meeting on said Shoreline Conditional Use Permit and height variance on January 3,1995 and concurred with the Findings of Fact,Conclusions and Recommendation of the Hearing Examiner;NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.The Findings of Fact,Conclusions and Recommendation of the Hearing Examiner with respect to the above-referenced Shoreline Conditional Use Permit under File No.PA 9301001 is hereby approved. 2.The Shoreline Conditional Use Permit and height variance for the above-described property shall be perpetually conditioned upon strict compliance with each of the conditions set forth in the Recommendation of the Hearing Examiner. Violation of any of the conditions of said decision may result in revocation of the Shoreline Conditional Use Permit and height variance or enforcement action being brought by the City. 3.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by Writ of Certiorari,Writ of Prohibition,or Writ of Mandamus within fifteen (15)calendar days after the passage of this resolution.
