HomeMy WebLinkAboutR-1721 - Declaring its intention to order the construction, installation and replacement of sewer mains and appurtenances along 84th Street NE at 45th Drive NEr '-... .' ; CIT Y 0 F MAR Y S V ILL E Marysville, RESOLUTION Washington NO.J7.l1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,REPEALING RESOLUTION NO.1718 OF THE CITY,DECLARING ITS INTENTION TO ORDER THE CONSTRUCTION,INSTALLATION AND REPLACEMENT OF SEWER MAINS AND APPURTENANCES ALONG 84TH STREET NE AT 45TH DRIVE NE AND ALONG 45TH DRIVE NE AT 84TH STREET NE AND TO CREATE A LOCAL IMPROVEMENT DISTRICT TO BE KNOWN AS LOCAL IMPROVEMENT DISTRICT NO.65 TO ASSESS A PART OF THE COST AND EXPENSE OF CARRYING OUT THOSE IMPROVEMENTS AGAINST THE PROPERTIES SPECIALLY BENEFITED THEREBY,AND NOTIFYING ALL PERSONS WHO DESIRE TO OBJECT TO THE IMPROVEMENTS TO APPEAR AND PRESENT THEIR OBJECTIONS AT A HEARING BEFORE THE CITY COUNCIL TO BE HELD ON MARCH 27,1995. WHEREAS,the city Council of the city of Marysville, Washington (the "City"),adopted Resolution No.1718 on February 6, 1995,which resolution declared the City's intention to initiate the formation of Utility Local Improvement District No. 19 ("OLID No.19")to construct and finance certain sewer improvements;and WHEREAS,the City Council since has concluded that such construction and financing can be more effectively accomplished if a local improvement district were to be created instead of OLID No.19;NOW,THEREFORE; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON,as follows: Section 1.Resolution No.1718 declaring the intention of the City of Marysville,Washington (the "City")to initiate the formation of utility Local Improvement District No. 19 ("OLID No.19")and fixing the date,time and place for a public hearing on the formation of the proposed OLID No.19,passed by the City Council and approved by the Mayor on February 6,1995,should be and is repealed. Section 2.It is the intention of the City Council of the City of Marysville,Washington,to order the improvement of the properties within the area described in Exhibit A,attached hereto and by this reference made a part hereof,and the formation of a local improvement district to be known as Local Improvement District No. 65 ("LID No. 65 or the "LID")by the construction, installation and replacement of 656 lineal feet of 10-inch sewer main and appurtenances along 84th Street NE at 45th Drive NE and 0172409.01 -1- s the construction and installation of 555 lineal feet of 8-inch sewer main and appurtenances along 45th Drive NE at 84th street NE (the "Improvements").All of the foregoing Improvements shall be in accordance with the plans and specifications therefor prepared by Hammond,Collier &Wade-Livingstone Associates,Inc.,consulting engineer of the city and may be modified by the city as long as that modification does not affect the purpose of the Improvements. section 3.The total estimated cost and expense of the Improvements is declared to be $188,015 and approximately $59,203 of that cost and expense shall be paid by the city and the balance thereof shall be borne by and assessed against the property specially benefited by the Improvements to be included in LID No. 65 to be established embracing as nearly as practicable all the property specially benefited by the Improvements.Actual assessments may vary from estimated assessments as long as they do not exceed a figure equal to the increased true and fair value the Improvements add to the property. section 4.The city Clerk is authorized and directed to give notice of the adoption of this resolution and of the date,time and place fixed for the pUblic hearing to each owner or reputed owner of any lot,tract,parcel of land or other property within the proposed LID No. 65 by mailing such notice at least fifteen days before the date fixed for public hearing to the owner or reputed owner of the property as shown on the rolls of the Snohomish County Assessor at the address shown thereon,as required by law.The city Clerk also is authorized and directed to give notice of the adoption of this resolution and of the date,time and place fixed for the pUblic hearing to each owner or reputed owner of any lot, tract,parcel of land or other property outside of the proposed LID No. 65 that is required by the Federal Housing Administration as a condition of loan qualification to be connected to the proposed Improvements,by mailing such notice at least fifteen days before the date fixed for the public hearing to the owner or reputed owner of the property as shown on the rolls of the County Assessor at the address shown thereon,as required by law. This resolution also shall be published in at least two consecutive issues of the official newspaper of the City,the date of the first pUblication to be at least fifteen days prior to the date fixed for the pUblic hearing. section 5.All persons who may desire to object to the Improvements are notified to appear and present those objections at a hearing before the city Council to be held in the Council Chambers at the Public Safety Building located at 1635 Grove Street in Marysville,Washington,at 7:00 p.m.on March 27,1995,which time and place are fixed for hearing all matters relating to the Improvements and all objections thereto and for determining the method of payment for the Improvements.All persons who may desire to object thereto should appear and present their objections at that hearing.Any person who may desire to file a written protest with the city Council may do so within 30 days after the date of 0172409.01 -2- '..-.~..~.,.....,-'''''~~''~-''~''~.''''''••'I'''''''''''''''·'' ..".~~,......~.....~""'--'--'''''''''''''''''''~'''''''''''''''~''''~I'',",.,.''''.' ...,..•._•.•.,.,.<O',.~......,_......~• '•n·....... pass.9g!'!_of_the..ordinance ordering the Improvements in the event the10><._..-.,.,..,..........~·.r·..'.- local improvement district is formed.The written protest should be signed by the property owner and should include the legal description of the property for which the protest is filed and that protest should be delivered to the city Clerk at city Hall,514 Delta Avenue,Marysville,Washington. section 6.Hammond,Collier &Wade-Livingstone Associates, Inc.,is directed to submit to the City Council on or prior to March 27,1995,all data and information required by law to be submitted.
