Kloster property located at 9025 67th Avenue NE Marysville WashingtonCITY OF MARYSVILLE Marysville,Washington RESOLUTION NO.17;}'f A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FORTHE KARL A.KLOSTER PROPERTY LOCATED AT 9025 -67TH AVENUE N.E.,MARYSVILLE,WASHINGTON. WHEREAS,on January 13,1995 Karl A.Kloster applied for a utility variance for one water connection without sewer for property located at 9025 -67th Avenue N.E.,Marysville, Washington;and WHEREAS,on February 6,1995 the City Council of the City of Marysville held a public meeting concerning the variance application and made the following findings: 1.The applicant's property is outside the City's Rural Utility Service Area,but is within the CWSP and Interim Urban Growth Boundary. 2.The applicant jointly shares a well with his parents, and the well has progressively declined during the past three summers. 3.The applicant has indicated that he is attempting to sell the subject property,but has been informed that financing would not be granted until an alternate source of water has been provided.Said information is provided in a letter dated January 12,1995 from the applicant,which is incorporated by this reference. 4.There is a City of Marysville 12-inch water main in 67th Avenue N.E.which fronts the west side of the applicant's property.The existing sanitary sewer is not within 200 feet of the applicant's residence and therefore,a sanitary sewer connection would not be required. 5.In light of the above-referenced findings,the authorization of the variance for one single-family residence at 9025 -67th Avenue N.E.will not be materially detrimental to the public interest,welfare,or the environment. 6.In light of the above-referenced findings,the granting of a variance in this case will not be inconsistent with the long-range plans of the City utility system or jeopardize utility availability for properties within the City limits,due to the fact that this request is for one water connection only for a single-family residence. RESOLUTION - 1 /rrrv/kloater.res -------------------------------------- ,--..,...,...# NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASH!NGTON AS FOLLOWS: 1.The variance for the applicant's connection to City water without sewer is hereby granted subject to the following conditions: a.The variance shall be for one single-family residence located at 9025 -67th Avenue N.E.,Marysville, Washington. b.The applicant shall have connected to the City water utility within six (6)months of the date of this resolution. c.The granting of this variance shall be subject to the applicant executing a covenant not to protest annexation of his property to the City of Marysville. 2.Any party aggrieved by this resolution shall have the right to file an application for a writ of certiorari in Snohomish County Superior Court;PROVIDED,that the application must be filed and served within 20 days of the date of this resolution. ~PASSED by the City J.,.7.day of ~ Council and APPROVED by the Mayor this ,1995.
