HomeMy WebLinkAboutR-1737 - Granting a conditional use permit and variance for property owned by the City of Marysville subject to conditionsCITY OF MARYSVILLE Marysville,Washington RESOLUTION NO.1737 A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A CONDITIONAL USE PERMIT AND VARIANCE FOR PROPERTY OWNED BY THE CITY OF MARYSVILLE SUBJECT TO CONDITIONS. WHEREAS,the City of Marysville owns certain real property located in the East ~of the N.E.~of the N.E.~of the S.E.~, Section 14,Township 30 N.,Range 5 E.,W.M.on approximately 4.8 acres in the City of Marysville;and WHEREAS,the Marysville Department of Public Works applied to the City for a Conditional Use Permit to construct a six (6) million gallon water reservoir to serve the 360-foot pressure zone of the City of Marysville for the purpose of providing potable water storage and fire flow protection to the City of Marysville;and WHEREAS,the City Hearing Examiner held a public hearing on April 27,1995 and adopted Findings of Fact,Conclusions and a Recommendation approving the Conditional Use Permit and variance subject to three (3)conditions;and WHEREAS,the City Council held a public meeting on said Conditional Use Permit and variance on June 6,1995 and concurred with the Findings of Fact,Conclusions and Recommendation of the Hearing Examiner;NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.The Findings of Fact,Conclusions and Recommendation of the'Hearing Examiner with respect to the above-referenced Conditional Use Permit and variance under File No.PA 9503018 is hereby approved. 2.The Conditional Use Permit and variance for the above- described property shall be perpetually conditioned upon strict compliance with each of the conditions set forth in the Recommendation of the Hearing Examiner.Violation of any of the conditions of said decision may result in revocation of the Conditional Use Permit and variance or enforcement action being brought by the City. 3.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by Writ of Certiorari,Writ of Prohibition,or Writ of Mandamus within fifteen (15)calendar days after the passage of this resolution.
