RESOLUTION NO.1740
A RESOLUTION OF THE CITY OF MARYSVILLE AFFIRMING THE DECISION OF
THE HEARING EXAMINER AND GRANTING A SHORELINE SUBSTANTIAL
DEVELOPMENT PERMIT AND VARIANCE FOR WELCO LUMBER COMPANY TO
ALLOW THE CONSTRUCTION OF A 15-FOOT-WIDE GRAVEL ROAD FOR THE
PURPOSE OF LOG TRANSPORT.
WHEREAS,Welco Lumber Company owns certain real property
located along the north shore of Ebey Slough,under the
Interstate 5 overpass,in the City of Marysville;and
WHEREAS,Welco Lumber Company applied to the City for a
Shoreline Substantial Development Permit to construct a 15-foot-
wide gravel road for the purpose of log transport;and
WHEREAS,the City Hearing Examiner held a public hearing on
April 27,1995 and adopted Findings of Fact,Conclusions and a
Recommendation approving the Shoreline Substantial Development
Permit and variance subject to six (6)conditions;and
WHEREAS,the City Council held a public hearing on said
Shoreline Substantial Development Permit and variance on June 26,
1995 and concurred with the Findings of Fact,Conclusions and
Recommendation of the Hearing Examiner subject to a revision of
Condition No. 6 as outlined below;NOW,THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The Findings of Fact,Conclusions and Recommendation of
the Hearing Examiner with respect to the above-referenced
Shoreline Substantial Development Permit under File No.9501003
is hereby approved.
2.The Shoreline Substantial Development Permit and
variance for the above-described property shall be perpetually
conditioned upon strict compliance with each of the conditions
set forth in the Recommendation of the Hearing Examiner;
provided,that the Hearing Examiner's Condition NO.6 shall be
revised to read as follows:
6.Welco shall not significantly impede the use
of the boat ramp or the area between the proposed haul
road and the proposed bypass road.

right of appeal by any aggrieved party to the Superior Court of
Snohomish County by Writ of Certiorari,Writ of Prohibition,or
Writ of Mandamus within fifteen (15)calendar days after the
passage of this resolution.
