A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY
VARIANCE FOR NORETEP, A WASHINGTON GENERAL PARTNERSHIP,
LOCATED AT 18118 SMOKEY POINT BOULEVARD,ARLINGTON,
WASHINGTON.
WHEREAS,on September 29,1995 Noretep applied for a utility
variance for water service only for property located at 18118
Smokey Point Boulevard,Arlington,Washington;and
WHEREAS,on October 9,1995 the City Council of the City of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.The subject property is located outside the city
limits,outside the RUSA boundary,outside the CWSP and the Urban
Growth boundary.However,the applicant's property is adjacent
to the City's RUSA boundary.
2.There is a la-inch water main in 35th Avenue.
3.The applicant has approved septic plans from Snohomish
County.No sewer is available in the vicinity of applicant's
property.
4.The applicant has applied for ten (10)water
connections without sewer for single-family dwellings.
5.Pursuant to Resolution 1688,the City denied without
prejudice a utility variance for the applicant during the
pendency of the updating of the City's Water Comprehensive Plan.
The Water Comprehensive Plan has now been updated and does
include the applicant's property.
6.By letter dated March 3,1994,the City of Arlington
has indicated that it is unable to provide water service to the
applicant's property.
7.In light of the above-referenced findings,the
authorization of the variance will not be materially detrimental
to the public interest,welfare,or the environment.
8.The above-referenced findings reflect exceptional or
extraordinary circumstances or conditions applying to the subject
property that do not apply generally to other properties in the
same vicinity.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same vicinity.

10.The granting of a variance in this case will not be
inconsistent with the long-range plans of the City utility system
or jeopardize utility availability for properties within the City
limits,so long as this utility connection is limited to the
current use,which is single-family residential.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The variance for the applicant's connection to City
water only is hereby granted subject to the following conditions:
a.The applicant is specifically advised that at the
present time the water pressure in the vicinity of its
property is approximately 45 to 50 psi.However,there is a
possibility that the water pressure could be significantly
less in the future.In such event,it will be the
applicant's sole responsibility to install booster pumps or
other appropriate technology at its own risk to provide
appropriate pressure.
b.The applicant shall be required to sign an
annexation covenant in favor of Marysville.
2.Resolution No.1688 is hereby repealed for the reason
that it is replaced by this resolution.
3.Any party aggrieved by this resolution shall have the
right to file an application for a writ of certiorari in
Snohomish County Superior Court;PROVIDED,that the application
must be filed and served within 20 days of the date of this
resolution.
PASSED by the City Council and APPROVED by the Mayor this
